The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Barbara Muse presiding and the following Commissioners present: Hall, Hammersmith, Dickey and Tedder. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Jim Forsyth, Chris Land, Tim Rinke, Troy Lankton, Tami Greve.
Commissioner Tedder made the motion to amend the minutes of the previous meeting. The motion was seconded by Commissioner Hammersmith. Motion carried.
APPROPRIATION ORDINANCE
Claim Ordinance #5587 making appropriation for $148,851.22 for the payments of certain claims against the City of Anthony for appropriation ordinance was presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.
STREET DEPARTMENT REPORT
J. D. Rhea, Street Department Head reported that the Department was patching pot holes. They have been cutting trees, worked on windows at the Warrior Field House, and doing everyday maintenance. They are grading roads and mowing.
FINDINGS OF FACT AND ORDER – 124 N. LINCOLN
Mayor Muse read the Findings of Fact regarding a Health Nuisance for 124 N. Lincoln. Mayor Muse made the motion that the City accept the Findings of fact and issue the Order to Jerry D. Baysinger and Teresa A. Baysinger for the Abatement of Health Nuisance for their property at 124 N. Lincoln. The motion was seconded by Commissioner Dickey. Motion carried.
EXECUTIVE SESSION
Commissioner Dickey made the motion that the City Commission go into Executive Session for 15 minutes for discussions prior to the Acquisition of Property. Jim Forsyth, City Attorney; Grant Sechler, City Superintendent; John Blevins, Chief of Police; and Don Heidrick, City Clerk /Administrator remaining. The motion was seconded by Commissioner Hammersmith. Motion carried.
At 8:50 a.m. the City Commission room was cleared with the City Attorney, City Superintendent, Chief of Police and the City Clerk/Administrator remaining. At 9:05 a.m. Mayor Muse called the Meeting back into Regular Session. No decisions were made.

Commissioner Dickey made the motion that the City Commission go into Executive Session for 10 minutes for discussions prior to the Acquisition of Property. The motion was seconded by Commissioner Dickey. Motion carried.
At 9:15 a.m. the City Commission room was cleared with the City Attorney, City Superintendent, Chief of Police and the City Clerk/Administrator remaining. At 9:25 a.m. the Mayor called the Meeting back into regular session. No decisions were made.
CAR SHOW REQUEST
Troy Lankton was present to request the barricading the block of 100 E. Spring and the block of 200 N. Anthony for the Annual Car Show. Commissioner Tedder made the motion that the City barricades the block of 100 E. Spring and the block of 200 N. Anthony, for the Annual Car Show on May 9th. The motion was seconded by Commissioner Dickey. Motion carried.
CONTRACTOR REQUEST
Tim Rinke was present to discuss in the length the requirement for a license. He indicated that the test for a license did not have items that covered his line of work and that City Personnel did not qualify to inspect. The test required has been used for some time by the City. The City Commission told him he needed to take the test available in order to get a license.
WYOMING WIND POWER-MURPHY INTERNATIONAL DEVELOPMENT CORPORATION
Chris Land of Wyoming Wind Power, representing Murphy International Development Corporation was present to discuss an engagement letter and retainer for services. After lengthy discussion it was decided to table the request. The City will wait for more information from the Alternative Energy Committee to review other companies. Greg Wilson of 21st Century Consultants will be contacted for the possibility of more information about Wind Power and its working with Power Plant Production.
TAX CREDIT INCENTIVE PROGRAM SUPPORT REQUEST
Tami Greve, Director of Marketing at the Anthony Medical Center was present to request the Commissioners for a letter of support for Tax Credit Application for the Anthony Medical Center. The Center wants to purchase a new up-to-date CT Scanner. Mayor Muse made the motion that the City provides a letter of support for the Anthony Medical Center Application for a Tax Credit Incentive Program. The motion was seconded by Commissioner Tedder. Motion carried.
CITY-WIDE CLEAN UP BIDS
The City received two bids for the City-Wide Clean Up. Lateith McVea with Haul Away “R” Us bid was $7,900 and Wyatt Trash Services bid was $9,500. After lengthy discussion, the City Commission decided to look at a Clean-Up Program at Budget time and maybe have the City doing it.
Commissioner Hall made the motion that the City-Wide Clean Up for this year be tabled and the cost re-examined for next year at Budget time. The motion was seconded by Commissioner Hammersmith. Motion carried.
HOUSING ADVISORY COUNCIL APPOINTMENTS
Gwen Warner and Diane Leland have indicated they would be interested in serving on an Anthony Housing Advisory Council. No one else has indicated an interest. Commissioner Tedder indicated he would serve on the Council.
Commissioner Hammersmith made the motion that the City appoints Diane Leland, Gwen Warner and Commissioner Tedder to the Anthony Housing Advisory Council. The motion was seconded by Commissioner Dickey. Motion carried.
CITY OFFICERS APPOINTED
Mayor Muse made the motion that the City re-appoints the following Officers for two years: Angie Hartman, Treasurer; Richard Befort, Municipal Judge; Grant Sechler, City Superintendent; John Blevins, Chief of Police; and Don Heidrick, City Clerk/Administrator. The motion was seconded by Commissioner Hall. Motion carried.
PROCLAMATION – ARBOR DAY
Mayor Muse signed a Proclamation to declare April 24, 2009 as Arbor Day in the City of Anthony. Arbor Day will be held at the East Park, at 4:30 p.m. on April 24, 2009.
QUESTION SEWER LIFT STATION FOR MASSACHUSETTS
Commissioner Tedder questioned the necessity of having the proposed Sewer Lift Station for the Massachusetts Property and the cost to property owners. City Superintendent Sechler said he would like to discuss the development of the Lift Station Project with Commissioner Tedder. It would eliminate septic systems in that area.
CITY SUPERINTENDENT REPORT/PROJECTS/RENEW THE ENERGY PROJECTS/ZONING REGULATIONS/WESTERN FARMERS MEETING/BOY SCOUT REQUEST
City Superintendent Sechler had presented opinion of probable cost for projects, for the Water, Wastewater/ K-2 Highway Sealing and Airport Projects. He had been on the phone about regulations for Electric customers that might want to put in their own renewable energy source (Wind Power, etc.)
He also spoke with a consultant on working on Zoning Regulations that would apply to wind tower generators.
The Meeting with Western Farms was informative. He also spoke with KMEA Power Supply Division and they will send cost comparison. He completed two reports for Department of Energy.
He worked on several building permits.
A Boy Scout would appreciate help from the City for his Flag Pole Project for Scouts It was consensus of the Commission for the City to assist him in the setting of the Pole.
CHIEF OF POLICE REPORT/DRIVERS LICENSE-DUI PROGRAM/PREVENTION OF UNDER AGE DRINKING GRANT MEETING/BALLOON FEST/VACATION
Chief Blevins reported Officer Hodson, KHP Trooper Reams and he presented a Drivers License/DUI Program to the Anthony 8th grade classes. Very good response to the program.
He attended the Prevention of Under Age Drinking Grant Meeting.
He is the Law Enforcement Sector Representative.
KWCH 12 made a presentation for Media Campaign for the Program.
He contacted several businesses for placement of a flight simulator and possible food court trailer in the 200 block of West Main for the Balloon Fest. There will be no problem for getting Electrical hook-ups.
He will be on vacation April 24th to May 2nd, 2009.
GENERATOR RECOMMENDATION
Water/Wastewater Department Head, Terry stark recommended the purchase of the Wacker Neuson 6600A Generator from Anderson Welding for $2,465.97. Commissioner Hall made the motion that the City approves the purchase of a Wacker Neuson 6600A Generator from Anderson Welding for $2,465.97. The motion was seconded by Commissioner Hammersmith. Motion carried.
CITY CLERK/ADMINISTRATOR REPORT/ TRANSFER/SPECIAL STREET AND HIGHWAY FUND/AUDIT BEGINS
The City Clerk/Administrator reported that $50,000 more was transferred from the Electric Department Fund to the Electric Reserve for March.
The City received $11,219.48 for April quarterly payment for the Special Street and Highway Fund. This is down from $14,420.01 last year.
Auditors will be here to begin the 2008 audit, April 27th.
WAYNE DENNIS FUND COMMITTEE
Commissioner Tedder asked about the Wayne Dennis Fund Committee and if they were going to meet. They will be contacted about having a meeting.
RESIGNATION
The City received a resignation from Terry Messick from the Industrial Development Board.
Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Hall. Motion carried.
