The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 A.M. with Mayor Hatfield presiding and the following Commissioners present: Hekel, Hammersmith, Dickey, and Williams. Absent: None. Also present were Don Heidrick, City Clerk/ Administrator; Grant K. Sechler Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of The Anthony Republican; Kenny Hodson, Major Weiss, Steve Wilkinson, Donna Crowe, Brad Giesen, Brandon Hazel, Jim and Linda Bergman.

The minutes of the previous meeting were approved as amended.

APPROPRIATION ORDINANCE APPROVED

Claim Ordinances #5501 making appropriations for the payments of certain claims against the City of Anthony in the sum of $85,697.45 for appropriation ordinance was presented and on motion by Commissioner Williams, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.

ELECTRIC DISTRIBUTION DEPARTMENT REPORT

Steve Wilkinson, Electric Distribution Department Head, reported on the activities of his Department.

They have been wiring the Police garage. Everything is done except the lights outside.

They have used the infrared camera. They found some connections that need repair.

He is glad Frazier Building is down without taking out any power lines. Meter loop for Christmas decoration received some damage.

New digger truck has oil leak in the boom. Altec is repairing that.

They are working on new service east of town. Otherwise doing everyday maintenance and replacing poles.

Mayor asked about getting up poles for Christmas decorations before it gets to be too late.

301 SOUTH BLUFF STATUS

Major Weiss was present to request the City hold off having the structure at 301 South Bluff demolished as scheduled. He is interested in purchasing the property, and repairing the structure. Officer Hodson stated he was concerned about the time frame for the structure to be repaired. There is pile of cement, and back wall exposure is a concern now.

Commissioner Hammersmith made the motion that City extend the deadline set in Finding of Facts and Order for 301 South Bluff and give 90 days from today to meet the Order, and Finding of Facts sent to Terherst's July 2, 2007. The motion was seconded by Commissioner Dickey. Motion carried.

RECREATION COMMISSION REPORT

Donna Crowe, Brad Giesen and Brandon Hazel discussed the needs of the Recreation Program. It was their recommendation to purchase two big mowers for Recreation instead of trading the John Deere mower tractor and keep it to drag the fields. They would like to keep and repair the old block building at the football field for storage and/or fix restrooms. It would have to be an extra lease/purchase to get the mowers.

It was discussed about the need for bleachers at the Pool for Pool Swim Meets. They are estimated $500 each and six would be needed. Wayne Dennis Fund was mentioned to request money for them and maybe School District would help with the cost, and they could use the bleachers for school tennis meets. Kiwanis and Lions were mentioned as possible sources of revenue.

The Recreation Commission would have to take care of the old field area for kids football and soccer use and City mow outlying area during the season and help with mowing during the off season.

There was discussion of forgiving lease/purchase for the lighting renovation project with the Electric Department to pay for new mowers. Superintendent Sechler suggested splitting the old lease/purchase payment with half going for the lighting renovation project and half to a new lease/purchase for the new mowers cost.

VERMONT STREET VACATION

Jim and Linda Bergman were interested in having part of Vermont Street vacated. They are still interested in building a house. A brother-in-law is interested in building a house also. They would be willing to purchase adjoining lots, at a reasonable price.

It will be determined what could possibly be done and try to work a mutual agreement with the Bergmans.

COMMISSIONER HEKEL COMMENTS AND LEAVES

Commissioner Hekel commented this was not right after what was done last week with Susan Croft request. There was further discussion of what was done last week, and that this was a different issue. Commissioner Hekel left the meeting.

CALL ATTEMPTED TO SUSAN CROFT

The Mayor asked other members of Commission present if it would be alright to contact Susan Croft and inform her the City would consider selling the property next to the proposed vacated Vermont Street authorized by the City Commission last week. Susan Croft could not be reached during the meeting.

RE-APPOINTMENTS TO ANTHONY INDUSTRIAL DEVELOPMENT BOARD

Commissioner Hammersmith made the motion that the City re-appoint Terry Messick, Jerry Turner, Don Jensen and Phil Schmidt to the Anthony Industrial Development Board for four year terms. The motion was seconded by Commissioner Dickey. Motion carried 3-1, Commissioner Williams voting no.

MUNICIPAL HALL ALCOHOL CONSUMPTION EXEMPTION APPLICATIONS

The League, ABC, and City Attorney were contacted about the requirements for Municipal Hall Alcohol Consumption Exemption Application.

Commissioner Williams made the motion that the City approve the Municipal Hall Alcohol Consumption Application for Justin Francis and Christie Randolph. The motion was seconded by Commissioner Hammersmith. Motion carried.

Commissioner Williams made the motion that the City approve the Municipal Hall Consumption Certificate Application for Roger McKnight, for a Class Reunion, pending payment of $50 fee required if alcoholic beverage is to be consumed. The motion was seconded by Commissioner Dickey. Motion carried.

ORDINANCE NO. S-186 ADOPTED

A SPECIAL ORDINANCE PROVIDING FOR CONSUMPTION OF CEREAL MALT BEVERAGE AT THE ANTHONY CITY PARKING LOT NEXT TO IDLE HOUR, FRIDAY, AUGUST 24, 2007.

Commissioner Williams made the motion that the City adopt Ordinance No. S-186. The motion was seconded by Commissioner Hammersmith. Motion carried.

2008 BUDGET HEARING

Commissioner Williams made the motion that the City hold the 2008 Budget Hearing on August 27, 2007, 9:30 A.M., 124 South Bluff, in the City Commission Room. The motion was seconded by Commissioner Dickey. Motion carried.

CHIEF OF POLICE REPORT / GARAGE CONCRETE APPROACH AND WIRING /

BURGLARY/THEFT CASES AND SHOPLIFT CASE /

COUNTY ATTORNEY PURCHASES EVIDENCE CABINETS

Chief of Police Blevins reported the concrete garage approach for the Police garage was complete. The wiring has been completed by Electric Crew.

They continue to investigate several burglary/theft cases. Worked Alco shoplift case. There is juvenile suspect. Case to County Attorney.

The County Attorney agreed to purchase five cabinets for the new property/evidence room in the garage, giving each officer one to secure case evidence.

CITY SUPERINTENDENT'S REPORT / KDOT AIRPORT PROJECTS /

WATER METERS REPLACED / HOUSING DEVELOPMENT /

TREE REMOVAL / EXCESS RUNWAY REPAIR

City Superintendent Sechler reported KDOT will be here to look at East Main Geometric Project application, August 22, at 3:45 P.M. Hopefully some Commissioners can attend. He will plan to contact the Chamber and Housing to see if they could come to meeting. Also some of the disabled that use scooters.

He has application forms from KDOT for projects at Airport. He is contacting the Airport engineer.

The Water Department replaced two water meters on empty lots on Main Street before sidewalk is installed.

He is still working on the issues for the Housing Development in northwest part of town. The City will need a little more utility easement for the sewer line installation.

Commissioner Hammersmith said he had an inquiry from Charles Masner about a tree that was leaning toward power line that had been damaged by storm on Steve Masner property, if it could be removed. Superintendent will check on it. There may be water line under it.

He also asked about who maintains excess runway to Copenhaver's hangar that has pot hole, that caused damage to Copenhaver's plane. Copenhaver asked about filling the pot hole. Superintendent will look into it. City can fill hole.

CITY CLERK/ADMINISTRATOR'S REPORT / ELECTRIC CASH AND RESERVE FUNDS /

REVOLVING LOAN FOR WASTEWATER PROJECT / CONTACT MIKE WYATT

City Clerk/Administrator Heidrick expressed concern about the low figures amounts in Electric Cash Fund and Electric Reserve Fund.

He asked about going ahead and checking into the Revolving Loan for the Wastewater Department projects. If the City could use money in existing City Funds and then use Loan.

Mike Wyatt will be contacted about mandatory curbside trash pick-up.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
