The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 A.M. with Mayor Hatfield presiding and the following Commissioners present: Hekel, Hammersmith, Dickey, and Williams. Absent: None. Also present were Don Heidrick, City Clerk/ Administrator; Grant K. Sechler Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of The Anthony Republican; Kenny Hodson, Donna Crowe, Larry Berry, Don Reber, Terry Messick, Tammy Walker, Mike Anderson, and Mike West.

The minutes of the previous meeting were approved.

APPROPRIATION ORDINANCE AND 8/21 CITY PAYROLL APPROVED

Claim Ordinance #5502 making appropriations for the payments of certain claims against the City of Anthony in the sum of $238,472.16 for appropriation ordinance and 8/21 City Payroll for $47,078.83 were presented and on motion by Commissioner Williams, seconded by Commissioner Dickey, said ordinance and 8/21 City Payroll were unanimously approved and claims ordered paid.

ELECTRIC PRODUCTION DEPARTMENT REPORT

Power Plant Superintendent Larry Berry reported on the work being done at the Power Plant. They are keeping grass mowed and Plant clean.

They had six peak days called this year by Western Farmers, untied from them and carried the system load for a five hour frame. The peak load has remained under 9 megawatts this summer. There are ten days yet in August that we have to untie for a 2 1/2 hour time frame.

Had a sufficient breakdown with Unit No. 3, Saturday, August 11th. We happened to have the parts in stock. The guys responded very well and were back on line in 4 hours. It was a rare breakdown that does not happen that much, but it did.

DON REBER REQUEST

Don Reber requested consideration for reduced costs for the new electric power pole, that replaced the pole he damaged with his tractor and drill. The damaged pole was considered rotten by people at the scene.

Superintendent Sechler would like to discuss it with the City workers before a decision is made.

INDUSTRIAL DEVELOPMENT BOARD REQUEST

Terry Messick, Chairman of the Anthony Industrial Development Board, reported the request by the Board to provide financial assistance to Jennings Investments Group who wants to reconstruct the roof of the Tradewinds Motel.

The Jennings Investments Group is to provide financial statement information. Estimates are $24,000 to $30,000 to do roof. Industrial Development Funds could be used from proceeds received from the sale of the KanOkla Building.

Mayor Hatfield made the motion that the City approve the request made by the Anthony Industrial Board to assist Jennings Street Investments Group in the financing of replacing the roof for the Tradewinds Motel Building, 322 West Main, Anthony, KS., after satisfactory and adequate financial statements, Business Plans, and letter of commitment from a Bank have been provided and met by the Jennings Street Investments Group and all others involved in Jennings Investments and all other persons having an interest in the project with a cap of $30,000. The motion was seconded by Commissioner Hammersmith. Motion carried 4-1 with Commission Williams abstaining.

MIKE ANDERSON REQUEST

Mike Anderson was present to request that he could purchase City land east of his Shop at the City Burnsite area, approximately 4.82 acres. He is thinking about building a house there. It would be approximate area from center of highway to impound lot.

Mayor Hatfield made the motion that the City proceed with the proposed sale of City land east of town to Mike Anderson and have the land surveyed at the cost of Mike Anderson, and find out appraised value of the land for negotiating a price. The motion was seconded by Commissioner Williams. Motion carried.

REQUEST EXTENSION FOR HOUSE REPAIR

Tammy Walker was present to request extension to repair the roof for the house they own at 315 North Springfield. It has been too hot, and they are trying to sell property. Mike Hodson said he could start to do the roof work in 2 1/2 weeks.

Kenny Hodson said door needs to be secured.

Mayor Hatfield made motion to extend the Order time to repair the house at 315 North Springfield until September 24, 2007 and the owners make sure doors are secured. The motion was seconded by Commissioner Dickey. Motion carried 4-1, Commissioner Hekel voting no.

ORDINANCE NO. G-2741 ADOPTED

AN ORDINANCE REGULATING TRAFFIC WITHIN THE CORPORATE LIMITS OF THE CITY OF ANTHONY, KANSAS; AMENDING SECTION 16-101 AND 16-102, OF CHAPTER XVI – TRAFFIC, ARTICLE 1 – STANDARD TRAFFIC ORDINANCE, OF THE CITY OF ANTHONY CITY CODE, INCORPORATING BY REFERENCE THE 'STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES,' EDITION OF 2007; WITH CERTAIN OMISSIONS, CHANGES, AND ADDITIONS; PRESCRIBING ADDITIONAL REGULATIONS, SECTIONS 16-103 THROUGH 16-104 OF THE ANTHONY CITY CODE, AND REPEALING ORDINANCE NO. G-2735.

Commissioner Williams made the motion that the City adopt Ordinance No. G-2741. The motion was seconded by Commissioner Hammersmith. Motion carried.

ORDINANCE NO. G-2742 ADOPTED

AN ORDINANCE REGULATING PUBLIC OFFENSES WITHIN THE CORPORATE LIMITS OF THE CITY OF ANTHONY, KANSAS; ADDING AND AMENDING SECTIONS 13-101, 13-102, 13-103, 13-104 and 13-105 TO CHAPTER 13 – PUBLIC OFFENSES, ARTICLE 1 – UNIFORM PUBLIC OFFENSE ORDINANCE OF THE CITY OF ANTHONY CITY CODE, INCORPORATING BY REFERENCE 'THE UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES,' EDITION OF 2007; WITH CERTAIN OMISSIONS, CHANGES, AND ADDITIONS; PRESCRIBING ADDITIONAL REGULATIONS AND REPEALING ORDINANCE NO. G-2736.

Commissioner Williams made the motion that the City adopt Ordinance No. G-2742. The motion was seconded by Commissioner Dickey. Motion carried.

WAYNE DENNIS FUND COMMITTEE

Mayor Hatfield had received a report from the Wayne Dennis Committee meeting. They had voted to recommend a sound system for Municipal Hall. Sound Absorption Baffler would cost $13,074 and Sound System for $13,969.11.

Commissioner Hammersmith will have Gary Gerber to look at proposal and Commissioner Williams will have someone to look at proposal also.

The Wayne Dennis Committee turned down the request for funding trash receptacles for the Memorial Park. The School will be contacted about building them.

CURBS AROUND DOWNTOWN TENNIS COURTS

The Mayor would like to look into replacing street curbs around downtown tennis courts and get cost estimates.

LETTER TO SUSAN CROFT

The City Commission instructed the City Clerk/Administrator write a letter to Susan Croft to inform her that the property owned by the City would be for sale adjoining the proposed vacated Vermont Street with the same deal as made with the Bergmans.

CITY SUPERINTENDENT'S REPORT / SUNFLOWER H2O REGIONAL MEETING /

CONTRACTOR REVIEW OF TENNIS COURTS / PLANNING COMMISSION MEETING /

DEWEZE MOWER / POUR CONCRETE / CONFERENCE

City Superintendent Sechler reported that he plans to attend a Sunflower H2O Regional meeting at Medicine Lodge, Tuesday. A contractor will be here Tuesday at 2:00 P.M., to look at north tennis courts.

There is Planning Commission meeting on Thursday, at 6:30 P.M., in the City Commission Room. Two rezoning Public Hearings will be conducted.

The large DewEze mower is broken down. Crews are planning to pour concrete at the Shop and on Main Street.

He will attend Oklahoma Emerging Technology Conference on August 26th, 27th, and 28th, sponsored by Alfalfa Electric.

Playground Lake equipment will be installed soon. Pothole was repaired at Airport.

Trees referred to last week on Masner property is on City right-of-way and will be taken care of.

Floyd Barker is in hospital in Wichita and is not too good, and Demolition Crew is not working. The City Commission said to keep track of the penalty days.

KDOT will be here about the Geometric Project Application on Wednesday, August 22, at 3:45 P.M.

COMMISSIONER COMMENTS

Commissioner Hekel asked about tree stump removal. Superintendent Sechler said an attachment is available for the skid loader to remove tree stumps and when skid loader arrives he will look into it.

Tree grates are still on the agenda.

Retention ponds project needs to be resumed.

CHIEF OF POLICE REPORT / SCHOOL BOARD, SCHOOL CRISIS MEETINGS /

RAMBO – LOCKERS / GRAND OPENINGS / THANKS TO CITY CREW /

DISTURBANCE – 400 BLOCK OF NORTH ANTHONY

Chief of Police Blevins reported he attended School Board meeting and a School Crisis meeting at Chaparral.

Officer Schultz ran Rambo through the lockers at all the schools. This way we start with a new slate.

He attended Grand Opening for Anthony Antiques and Art Supplies at 601 East Main, and Anthony Motel.

Thanks to City Crew for finishing the drive and parking lot at the Police Department.

Officers responded to disturbance in 400 block of North Anthony. One arrest for battery, disorderly conduct.

CITY CLERK/ADMINISTRATOR'S REPORT / BUDGET /

CITY OF HARPER QUESTION /JULY BOOKKEEPING

City Clerk/Administrator Heidrick reported he is finishing up on Budget. Budget Hearing is next Monday at 9:30 A.M.

He reported Tonya Smith, City Clerk/Administrator at Harper, had contacted him about the possibility of a meeting of Harper City Council and Anthony City Commission for discussion of a possible water plant to solve the nitrate problem. A meeting would be possible and one should be set up.

HOME – HOMEOWNERS REHABILITATION APPLICATION PAPERS

Mike West of SCKEDD Office presented papers to be signed for the City of Anthony's HOME – Homeowners Rehabilitation Application.

Commissioner Williams made the motion that the City of Anthony's Mayor, Vice Mayor and City Clerk be authorized to sign for the City of Anthony the HOME – Homeowners Rehabilitation Application Papers. The motion was seconded by Commissioner Hekel. Motion carried.

CURB TRASH PICK-UP

The Commission discussed curb trash pick-up. Mike Wyatt is concerned about the initial cost for containers if the people were against it.

City Superintendent, City Administrator and maybe a couple of the Commissioners will meet with Mike Wyatt to discuss the possibilities for curb trash pick-up.

911 ADVISORY BOARD UPDATE / APPOINTMENT

Chief of Police Blevins reported that he had conferred with Cheryl Adelhardt, County Clerk, and she said the City should have received letter indicating an automatic member from each City to be appointed to the 911 Advisory Board. A letter has not been received.

Mayor Hatfield made motion to appoint Commissioner Hammersmith to the 911 Advisory Board. The motion was seconded by Commissioner Hekel. Motion carried.

Commissioner Williams made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Hammersmith. Motion carried.
