The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Howard Hatfield presiding and the following Commissioners present: Hekel, Dickey, Hammersmith and Williams. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Ron Poor, Wynona Mandevill, Barbara Wright, Bob Tedder, Ricky Baldwin, Terry Stark, Kenny Hodson, Jim Forsyth, Mel & Patricia King.
The minutes of the previous meeting were approved.
APPROPRIATION ORDINANCE and 8/19/08 PAYROLL APPROVED
Claim Ordinance #5553 making appropriation for $327,975.39 for the payments of certain claims against the City of Anthony for Appropriation Ordinance and $49,521.42 for 8/19 Payroll were presented and on a motion by Commissioner Williams, seconded by Commissioner Dickey, said ordinance and payroll were unanimously approved and claims ordered paid.
WATER/WASTEWATER REPORT
Terry Stark, Department Head reported on the Wastewater side that they had cleaned the Power Plant septic tank and tank on west side of Lake. Installed septic tank and sewer line on the west side of Lake. Still working on lateral field. Replaced #2 pump at McDonald’s lift station. Replaced motor on the circulator at sewer lagoon. Installed hand rails at restroom at Campsite A.
On the Water side, exposed water line and helped with culvert on Garfield. Pour concrete in 100 block of S. bluff. Repaired leaky water meters. Repaired 4” main water leak on N. Springfield and a 10” main to Power Plant.
Mowing, trimming, and general maintenance for both Water and Wastewater.
He asked about having the swimming pool painted. The Commission said to get estimates. There is a leak somewhere, but can’t pinpoint where. City Commission said to call in a pool expert, to help with finding the leak.
HOLD ON STREET IMPROVEMENT
Mayor Hatfield received an estimate to concrete the street and curb gutter south side of the street, the block south of the shop for $60,000. It will be put on hold.
EXECUTIVE SESSION
Commissioner Williams made the motion that the City Commission go into Executive Session for 15 minutes for consultation with the City Attorney on matters that would be deemed privileged in an Attorney-Client Relationship. The motion was seconded by Commissioner Hekel and at 8:50 a.m., the Commission room was cleared with the City Clerk/Administrator, City Superintendent, Police Chief, and City Attorney remaining. At 9:05 a.m., the Mayor called the meeting back into regular session. No decision was made.
SEWER PROJECT ON NORTH MASSACHUSETTS
Wynona Mandevill asked about the proposed sewer system work scheduled for N. Massachusetts. It was originally planned when Susan Croft was planning to build a house in that area. Minnie Helms, Pentecostal Church and Dick Downing would benefit and be required to hook on the sewer. They would pay part of it.
SIGNING OF THE LAKE LEASES
The City Attorney has recommended all listed persons on a Lake Lease sign the Lake Lease and then there would be no question of signatures required. He said that we could begin doing it now.
TRANSIENT GUEST TAX COMMITTEE RECOMMENDATION
The City Attorney was of the opinion that the Anthony Theater Group could request $5,000 to put towards the purchase of the Theater Building. The Transient Guest Tax committee had recommended that the City Commission approve $5,000 as a pledge if the goal of $42,000 to purchase the theater building is met. Commissioner Hammersmith made the motion that the City approves the recommendation of the Transient Guest Tax Committee for a $5,000 pledge from the Transient Guest Tax Fund for the purchase of the Anthony Theater Building if the goal of $42,000 to purchase the building is met. The motion was seconded by Mayor Hatfield. The motion failed 3-2 with Mayor Hatfield, Commissioners Hekel and Williams voting no.
LAND ACQUISTION QUESTIONED
Rick Baldwin was present to question of Atmos Energy purchasing the property at the corner of Washington and Pennsylvania. He did not believe the City was being fair, that he was interested in the property but did not know it was for sale. The Commission expressed that no one had come forth and indicate interest in the land. This was an opportunity for Industrial Development and the Construction of a $150,000 building on the property. Atmos is to pay $2,000 for the lot. They would work with Ricky Baldwin on getting another location for parking his truck.
FLAT BED BIDS
Bids had been received for a Flat Bed for the F450 Truck for the Street Department. Bids received include Midwest Truck $8,151; Truck Parts Equipment $8,050; Truck Parts and Equipment $9,355. Mayor Hatfield advised City Superintendent to study the bids to make sure specifications were met.
ORDINANCE NO. G-2747
AN ORDINANCE REGULATING PUBLIC OFFENSES WITHIN THE CORPORATE LIMITS OF THE CITY OF ANTHONY, KANSAS; ADDING AND AMENDING SECTIONS 13-101, 13-102, 13-103, 13-104, AND 13-105 TO CHAPTER 13 – PUBLIC OFFENSES, ARTICLE 1 – UNIFORM PUBLIC OFFENSE ORDINANCE OF THE CITY OF ANTHONY CITY CODE, INCORPORATING BY REFERENCE ‘THE UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, ‘ EDITION OF 2008; WITH CERTAIN OMISSIONS, CHANGES, AND ADDITIONS; PRESCRIBING ADDITIONAL REGULATIONS AND REPEALING ORDINANCE NO. G-2742.
Commissioner Williams made the motion that the City adopts Ordinance No. G-2747. The motion was seconded by Commissioner Dickey. Motion carried.
ORDINANCE NO. G-2748
AN ORDINANCE REGULATING TRAFFIC WITHIN THE CORPORATE LIMITS OF THE CITY OF ANTHONY, KANSAS; AMENDING SECTION 16-101 AND 16-102, OF CHAPTER XVI – TRAFFIC, ARTICLE 1 – STANDARD TRAFFIC ORDINANCE, OF THE CITY OF ANTHONY CITY CODE, INCORPORATING BY REFERENCE THE ‘STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES,’EDITION OF 2008; WITH CERTAIN OMISSIONS, CHANGES, AND ADDITIONS; PRESCRIBING ADDITIONAL REGULATIONS, SECTIONS 16-103 THROUGH 16-104 OF THE ANTHONY CITY CODE, AND REPEALING ORDINANCE NO G-2741.
Commissioner Williams made the motion that the City adopts Ordinance No. G-2748. The motion was seconded by Commissioner Dickey. Motion carried.
AUCTION FOR THE LEASE OF ANTHONY LAKE LOTS
The City Commission discussed the Auction Sale of two Lake Lot Leases. $10,000 would be minimum bid for each lease. A principal structure needs to be constructed within 5 years. 20% down payment day of Auction; City Attorney will be asked to review Auction Notice.
ORDERS
Officer Kenny Hodson presented findings of fact regarding the health nuisance on property at 201 N. Santa Fe, 115 N. 2nd, and the inoperable vehicle at 808 N. Anthony. Commissioner Williams made the motion that the City of Anthony approves the finding of facts and issue the Order to Eric S. Renner and Kristine Renner to abate the health nuisance within 10 days for 201 N. Santa Fe. Motion was seconded by Commissioner Hekel. Motion carried.
Commissioner Dickey made the motion that the City of Anthony approves the findings of fact and issue the Order for Alan W. Mardis to abate the health nuisance within 10 days for 115 N. 2nd. The motion was seconded by Commissioner Hekel. Motion carried.
Commissioner Hekel made the motion that the City of Anthony approves the finding of fact and issues the Order for Richard W. Garlow and Lori L. Garlow to abate the Inoperable Vehicle nuisance within 10 days at 808 N. Anthony. The motion was seconded by Commissioner Hammersmith. Motion carried.
CHIEF OF POLICE REPORT/MULTI-DISCIPLINARY TEAM MEETING/OUT OF STATE TAGS/SPEED SURVEY – GARFIELD
Chief Blevins reported that he attended a Multi-Disciplinary Team Meeting. Continue to send out Notices for weed, health and autos. Working on Out of State tags.
Reported on the speed survey on Garfield. The City Commission’s consensus was that the survey at this time does not warrant increasing the speed limit.
CITY SUPERINTENDENT REPORT/SUNFLOWER H20 MEETING/OIL FOR STREETS/PLANNING MEETING OLD HIGH SCHOOL/UTILITY BED BIDS/KCC REQUEST/FEMA/FUTURE SEWER PROJECTS/WEED PROBLEM/LAKE ROAD
City Superintendent Sechler reported that Sunflower H20 will meet August 19 at 7:00 p.m. in Medicine Lodge, he will attend.
He located for sale some MC-800 oil for sealing streets. It is around $3.10 per gallon. He estimates we will need 11,000 to 12,000 gallons. It was consensus of Commission to go ahead and try to find funding for it.
The Planning Commission met August 14th and voted 6-1 to begin rezoning procedures to rezone Old High School Property from B-1 Business District to R-1 Residential District.
He will finish specs for F-350 utility bed this week.
KCC called to request new rate information. FEMA completed paperwork for storm damage to the electric system.
Alan Luttrell with EBH was here Wednesday reviewing the future sewer projects.
He will take a day of vacation Thursday and maybe Friday.
The County is charging $350 per year for access to their aerial maps. Could be option for mapping our utilities and zoning. Mayor Hatfield expressed that he did not believe City should have to pay for this service.
Commissioner Hekel asked about the weed problems on the County Property east of Courthouse. He also asked about Lake Road. Sechler said with the oil price and availability of oil, it may not be done this year.
2009 BUDGET
City Clerk/Administrator reported that according to Kevin Cowan Bond Attorney for Gilmore and Bell that sales tax revenue could be used also for bond payments for the Street Improvement General Obligation Bond Issue. Previously John Haas of Ranson Financial Consultants had indicated that the Sales Tax Revenue could be used only for payments for the Sales Tax Revenue Bond Issue not the General Obligation Bond Issue. Cowan also said the sales tax revenue could be used for Street maintenance needed for the previously improved streets. This would free up the Special Street and Highway Revenue, and the Budgeted amounts for General Obligation Bond payments from General Operating Fund.
CITY CLERK/ADMINISTRATOR REPORT/I.D. BUILDING LEASE/FLATBED AND UTILITY TRUCK BOX FINANCING/AIRPORT LEASE PAID
City Clerk/Administrator reported the lease for the I.D. Building was up to date. He will finance the flatbed for the new Street Department truck with a lease/purchase and take cost for Water/Wastewater utility truck box from the Budget.
He reported Airport Lease had been paid.
NO MEETING WEEK OF LABOR DAY
It was consensus of the City Commission, that there will be no City Commission Meeting the week of Labor Day Holiday.
Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
