The Board of Commissioners of the City of Anthony, Kansas met in regular session at 6:00 p.m. with Mayor Barbara Muse presiding and the following Commissioners present: Dickey, Hammersmith, Hall, and Tedder. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Kate Catlin of the Harper County Herald; Donna Crowe, Kenny Hodson, Stephanie Buckman, Debbie Mangen, Don Jensen, Steve White, Marshall Martin, Mike Lanie, Larry Berry and Terry Stark.

The Invocation was given by Reverend Jim Anderson of the Nazarene Church.

Mayor Muse made the motion to approve the minutes of the previous meeting. The motion was seconded by Commissioner Hammersmith. Motion carried.

Mayor Muse made the motion to approve the minutes of the Special meeting, January 27, 2010. The motion was seconded by Commissioner Tedder. Motion carried.

APPROPRIATION ORDINANCE and 02/02/10 PAYROLL APPROVED

Claim Ordinance #5626 making appropriation for $54,565.30 for the payment of certain claims against the City of Anthony for appropriation ordinance and $47,573.11 for 02/02 Payroll were presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance and payroll were unanimously approved and claims ordered paid.

LAKE QUESTIONS

Mary Hixson of the Anthony Lake Board asked about new leases with changes; they will be worked up. The plan for the Dam in case of an emergency is also being work on. Nine Iron Drive needs some work done on it. It has pot holes and is like a one lane road now.

HEALTH INSURANCE

Stephanie Buckman of Blue Cross/Blue Shield gave a report on the 19% increase for the Employee Health Insurance. 15% is based on claim usage and 4% on Pool increase.

She also explained the Blue Choice Affordablue 50/50 Plan which is a step down of the present plan.

Employee profiles have been requested for Blue Cross/Blue Shield; hoping the re-entry rating may lower the 19% increase.

Profiles have been sent in now for Coventry Health Insurance. Group Benefits is working on getting these.

Kirk Kimble hopes the re-entry rating will lower the premium for Blue Cross/Blue Shield.

DANGEROUS STRUCTURE

Officer Kenny Hodson reported that the owner for the old Justice Battery Building has lowered the roof but the walls remain for the back part of the building. They would like extended time to have the building repaired.

Commissioner Dickey made the motion that the City extends the time to the owner for abating the Dangerous Structure at 206 E. Main to February 28, 2010. The motion was seconded by Commissioner Hall. Motion carried.

LETTER OF INTENT CHANGED

Mayor Muse made the motion that the City in the Letter of Intent dated November 2, 2009 which confirms the understanding between the City of Anthony, Kansas and

C2 H5 0H L.L.C., that the date of February 1, 2010 to execute a Contract be extended to March 15, 2010. The motion was seconded by Commissioner Dickey. Motion carried.

SWIMMING POOL SURVEY REPORT

Donna Crowe reported they had received 98 surveys. 73% were in favor and 27% voted no to increase the Pool Improvement Fee from $1.00 to $2.50. There was discussion about what needed to be done. The Virginia Baker Graham requirement was discussed. Superintendent Sechler suggested having an engineer report for the project. The engineer would provide specifications for bid proposals. There was a question of having time to have the improvements completed for the Pool to be open this summer. Engineer firms will be contacted.

PLANNING COMMISSION REPORTS

Mayor Muse read the Planning Commission Reports for cases NO. PC 09-01, NO. SU 09-02, NO. PC 09-03 and NO. SU 09-04.

ORDINANCE NO. S-206

AN ORDINANCE CHANGING THE ZONING CLASSIFICATIONS OF CERTAIN REAL ESTATE LOCATED WITHIN THE JURISDICTION OF THE CITY OF ANTHONY, KANSAS AND VARIANCES THEREOF.

Mayor Muse made the motion that the City adopts Ordinance No. S-206. The motion was seconded by Commissioner Tedder. Motion carried.

ORDINANCE NO. S-207

AN ORDINANCE ISSUING SPECIAL USE PERMIT FOR CERTAIN REAL ESTATE LOCATED WITHIN THE JURISDICTION OF THE CITY OF ANTHONY, KANSAS.

Mayor Muse made the motion that the City adopts Ordinance No. S-207. The motion was seconded by Commissioner Tedder. Motion carried

ORDINANCE NO. S-208

AN ORDINANCE CHANGING THE ZONING CLASSIFICATIONS OF CERTAIN REAL ESTATE LOCATED WITHIN THE JURISDICTION OF THE CITY OF ANTHONY, KANSAS AND VARIANCES THEREOF.

Mayor Muse made the motion that the City adopts Ordinance No. S-208. The motion was seconded by Commissioner Hammersmith. Motion carried

ORDINANCE S-209

AN ORDINANCE ISSUING SPECIAL USE PERMIT FOR CERTAIN REAL ESTATE LOCATED WITHIN THE JURISDICTION OF THE CITY OF ANTHONY, KANSAS.

Mayor Muse made the motion that the City adopts Ordinance No. S-209. The motion was seconded by Commissioner Dickey. Motion carried.

ANGIE HARTMAN AUTHORIZED

Barbara Muse made the motion that Angie Hartman, Anthony Assistant City Clerk be authorized to sign all legal agreements and documents and perform other duties normally done by the Anthony City Clerk/Administrator, in the absence of the present Anthony City Clerk/Administrator Don Heidrick. The motion was seconded by Commissioner Hall. Motion carried.

CITY SUPERINTENDENT REPORT/

SUNRISE ADDITION LIGHTS/MEETINGS/WATER PROJECTS/

DEMO PROJECT/INFORMATION FOR LAW FIRM/

WATER/WASTEWATER POSITION/SCHOOL BUILDING PERMIT/

FORGIVENESS OF FEES/KPP

Superintendent Sechler reported Street lights were being installed at Sunrise Addition. The project looks very nice. He has attended several meetings; Downtown Rebuilding, Wheatland Electric, and the Harper County Commission Meeting.

Superintendent Sechler has been in contact and has supplied information for EBH and Rural Development for Water Projects. Working with PEC on Downtown Demolition Project and supplying information for a law firm.

We had interviews for the Water/Wastewater Department position. He approved a building permit for the Anthony Elementary School addition. KDHE will not require an application for forgiveness of dumping fees.

KPP Board of Directors addressed the City of Anthony membership. It would be active if buying power.

CITY CLERK/ADMINISTRATOR REPORT/INSURANCE SHEETS/

LEAGUE CONFERENCE/FINANCIAL REPORTS/TAX MONEY/

EXECUTIVE SESSION

City Clerk/Administrator Heidrick reported he had worked up insurance sheets with new rates for discussion only. He thought that possibly we could use the employee fund again to help with the increase.

He reported the League Conference is in October and will be held at Overland Park at the Sheraton Hilton. A block of rooms will be opened soon.

Financial Reports for December and end of the year has been completed by Angie for review.

The City received $348,297.17 in tax money from the County Treasurer. Last year the City received $350,930.55. He would like to request an Executive Session for non-elected personnel.

CHIEF OF POLICE REPORT/NIMS/JR. HIGH STUCO/EXECUTIVE SESSION/

NEW LIGHTING AT POLICE DEPARTMENT

Police Chief Blevins reported he and Officer Hodson attended the NIMS (National Incident Management System) training.

He met with the Jr. High STUCO and got the Valentine Dance set up for February 13, 2010.

He would like an Executive Session for non-elected personnel. He expressed appreciation to the Electric Distribution Department crew for installing new lighting for the Police Department.

EXECUTIVE SESSION

Mayor Muse made the motion that the City Commission go into Executive Session for 15 minutes for discussion with non-elected personnel. The motion was seconded by Commissioner Tedder. Motion carried.

At 8:00 p.m. the City Commission room was cleared with the City Administrator and Chief of Police remaining. At 8:15 p.m. Mayor Muse called the meeting back into regular session. No decisions were made.

EXECUTIVE SESSION

Mayor Muse made the motion that the City Commission go into Executive Session for 5 minutes for discussion with non-elected personnel. The motion was seconded by Commissioner Tedder. Motion carried.

At 8:15 p.m., the City Commission room was cleared with the City Administrator and Chief of Police remaining. At 8:20 p.m., Mayor Muse called the meeting back into regular session. No decisions were made.

At 8:20 p.m., the City Commission room was cleared with the City Administrator remaining. At 8:30 p.m., Mayor Muse called the meeting back into regular session. No decisions were made.

Mayor Muse made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
