The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Howard Hatfield presiding and the following Commissioners present: Hekel, Dickey, Hammersmith and Williams. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; John Gaffney, Mike Lanie, Cynthia Clark, Steve Wilkinson, Lyle Welbrock, and Donna Crowe.

The minutes of the previous meeting were approved.

APPROPRIATION ORDINANCE and 2/17/2009 PAYROLL APPROVED

Claim Ordinance #5578 making appropriation for $66,833.12 for the payments of certain claims against the City of Anthony for appropriation ordinance and $44,392.34 for 2/17 Payroll were presented and on a motion by Commissioner Williams, seconded by Commissioner Dickey, said ordinance and payroll were unanimously approved and claims ordered paid.

ELECTRIC DISTRIBUTION DEPARTMENT REPORT

Steve Wilkinson, Electric Distribution Department Head gave a report on the work of his Department.

Tracy Copenhaver’s service is done to the transformer. They replaced a pole north of David Hoopes’ house that had been hit. Worked on panel at storage tank, which we found problems in control box. The Company who put it in is coming to check it out. Rewired #2 well house at Harper Wells. Redid two house services in town. America Testing tested trucks. Ralph Wike is working on what he can and then will call Altec. They are working on lights at Fire Station in the old part. Chris Duwe and Jerry Angle went to UOM School at Garden City. He has been working with Grant and John Haas on the Rate Study. Grant needs a big thank you for the work he did with the project. Tennis Courts are on hold; problems with the concrete. Will work on poles in back alley way of Memorial Park.

THEATER GROUP

John Gaffney, Mike Lanie and Lyle Welbrock, were present to request the City’s assistance in applying for a CDB Grant. The City would need to be the sponsor. Donna Crowe said the City would have to wait until this Fall. One Grant for the Anthony Medical Center is open now. There was discussion of temporary land ownership. It was consensus of the Commission to wait until Fall, with Commissioner Williams abstaining because of his connection with the Anthony Medical Center and former owner of the Theater. The City Attorney will be contacted.

HARPER COUNTY ECONOMIC DEVELOPMENT COUNCIL APPOINTMENT

Mike Lanie, Harper County Economic Development Council Coordinator said that Mitchell Hall is interested in the position on the Harper County Economic Council. Kyle Clark withdrew his name. He said areas were in conformity with County Redistricting. Commissioner Williams objected to the County doing this and made the motion that the City drop from the Harper County Economic Development Council. There was no second to the motion so the motion died because of lack of second.

Commissioner Hekel made the motion that the City approves the appointment of Mitchell Hall to the Harper County Economic Development Council for the unexpired term that was held by Mike Carmichael. The motion was seconded by Commissioner Hammersmith. Motion carried 4-0-1 with Commissioner Williams abstaining.

CYNTHIA CLARK REQUEST

Cynthia Clark asked for an update on the status of the septic tank system installation at the Lake. Superintendent Sechler said it should be started next week.

She also asked about a Forum for the City Commission Candidates. She will contact the Chamber of Commerce.

RESOLUTION NO. 727

The City discussed the proposal of Resolution NO. 727 changing the Camping Rates and time permitted. The City would want to protect the rights of town businesses allowing a 14 day stay at the Lake before having to move from Lake for 5 days, unless approved by the City. City Superintendent will approve those who qualify. Construction workers and Custom Cutters staying over one month will have to be presented to the City Commission.

A RESOLUTION ADOPTING SCHEDULES, FEES AND REGULATIONS FOR THE ANTHONY MUNICIPAL LAKE AND REPEALING RESOLUTION NO. 658.

Commissioner Williams made the motion that the City adopts Resolution NO. 727. The motion was seconded by Commissioner Hekel. Motion carried.

Superintendent Sechler will review Electric usage at the Lake to determine if present fees cover the City’s basic costs.

J-TURN ORDINANCE NO. G-2753

After extensive discussion, the City Commission adopted Ordinance No. G-2753.

AN ORDINANCE ADDING TO CITY CODE SECTION 16-102, AMENDMENTS TO STANDARD TRAFFIC ORDINANCE, PRESCRIBING REGULATIONS FOR J-TURNS AND ILLEGAL BACKING AND TURNING WHEN EXITING OF PARKING PLACES WITHIN CORPORATE CITY LIMITS OF THE CITY OF ANTHONY

Commissioner Williams made the motion that the City adopts Ordinance No. G-2753. The motion was seconded by Commissioner Hammersmith. Motion carried.

CHIEF OF POLICE REPORT/SCHOOL BOARD MEETING/MEETING WITH JR. HIGH STUCO/MULTI-DISCIPLINARY CHILD PROTECTIVE TEAM/HARPER COUNTY LOCAL EMERGENCY PLANNING/BALLOON FEST MEETING/DOMESTIC DISTURBANCE

Chief Blevins reported that the attended the School Board Meeting. He met with the Jr. High Stucco about the Valentine’s Party. He attended a Multi-Disciplinary Child Protective Team Meeting. Discussed several families of concern.

Attended the Harper County Local Emergency Planning Committee Meeting. Officer Houston attended the Balloon Fest Meeting.

They assisted the City of Harper with Rambo’s help. Domestic Disturbance in the 500 block of S. Spring, one juvenile in custody.

CITY SUPERINTENDENT REPORT/NORTH TENNIS COURT PROBLEM/SEWER CAMERA TRAINING /TRAILER/HARPER COUNTY LOCAL EMERGENCY PLANNING COMMITTEE/TRIP TO KANSAS CITY/STIMULUS PACKAGE/TRACK LOADER/SOUTH MASSACHUSETTS LOCATION

Superintendent Sechler reported that there were some major problems with the North Tennis Courts. It appears that some of the post tension cables have cracked the concrete. The contractor has been notified.

The installation of the new lights for the Tennis Courts has been put on hold. The Tennis Courts will be closed.

The Baker Company finished training on the Sewer Camera. A small enclosed trailer would be good to transport and keep the camera in.

He attended the Harper County Local Emergency Planning Committee Meeting on Friday.

Don Hellar of EBH wants to know if Thursday, February 19th would be a possible date to go to Kansas City to look at the Water Storage Tank. EBH has sent in the paperwork for a Stimulus Package for the Water Department Projects.

They will have the Track Loader for another week. The area to Lawrence Street needs to be cleaned out.

Mayor Hatfield expressed concern on South Massachusetts; a location where people believe is an access across private property now. This will be looked at.

CITY CLERK/ADMINSTRATOR REPORT/NO MINERAL RIGHTS MENTIONED/BALLOT FOR PRIMARY ELECTION/QUIT CLAIM DEED/DIRT TRACK/APPRECIATE TIME GRANT HAS PUT IN ON RATE STUDY

The City Clerk/Administrator reported that there was no mention of Mineral Rights in the previous land agreement with Mike Anderson. Checked with Couch Abstract.

Primary Election Ballot will read vote for 3 or fewer not 6 or fewer. An ad will be placed in the paper about the Election. He will take the Quit Claim Deed to the Housing Authority for transfer of West Acres to Interfaith Housing.

It was consensus of the Commission for the Dirt Track Group to work up an agreement for leasing the City property.

Expressed appreciation to Grant for the time he had spent on the Rate Study, checking rates, accounts etc.

MEMORIAL PARK LIGHTS

Donna Crowe had received several e-mails from Bill Ogden about the lights for Memorial Park. He said that he had received better quality glass globes that were $50.00 more a piece compared to the ones at the Lake. This would amount to $250.00 total more for the lights. He would like for the City to pay for the higher priced globes. It was consensus of the Commission that the City should only have to pay for what was ordered and billed in the first place. Mr. Ogden will be notified.

ALTERNATIVE POWER MEETING AT WICHITA

Commissioners Hekel and Williams reported on the Alternative Power Meeting in Wichita. It was primarily designed for home owners, not for municipalities. There was discussion of buying back Electricity by networking.

PROM REQUEST

The City Commission discussed a contribution to the Prom event. Will check on amount given last year.

SUNFLOWER RC&D SPONSORSHIP DUES

Commissioner Hekel made the motion that the City pays annual dues of $200 to Sunflower RC&D. The motion was seconded by Commissioner Dickey. Motion carried.

PLACE FOR SRS MEETING ROOM

Chief Blevins reported that S.R.S. is looking for a place for S.R.S. business, since their present location is at Harper Hospital and they are doing remodeling. He is checking with the Chamber of Commerce and County Attorney to find a place.

EXECUTIVE SESSION

Commissioner Hammersmith made the motion that the City Commission go into Executive Session for 50 minutes to discuss matters concerning non-elected personnel with the City Administrator remaining. The motion was seconded by Commissioner Williams. Motion carried.

At 10:40 a.m., the City Commission room was cleared with the City Administrator remaining. At 11:30 a.m., the Mayor called the meeting back into regular session. No decisions were made. The City Administrator left the Executive Session at 11:20 a.m.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Williams. Motion carried.
