The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Howard Hatfield presiding and the following Commissioners present: Hekel, Dickey, Hammersmith and Williams. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Dusty Linn & Rodger Linn, Wes Hughes, Edgar Barrett, Jerry Turner, Marilyn Downing, Don Jensen, Gary Gerber, and Brandon Gerber.

The minutes of the previous meeting were approved.

APPROPRIATION ORDINANCE

Claim Ordinance #5577 making appropriation for $64,440.25 for the payments of certain claims against the City of Anthony for appropriation ordinance was presented and on a motion by Commissioner Williams, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.

STREET DEPARTMENT REPORT

J. D. Rhea, Street Department Head reported they are cleaning up on South Pennsylvania. Cleaning up pole pile, and east side of South Vermont. They are doing everyday maintenance and will be cutting trees in town and at the Lake. They will check on extending the lease of the dozer to do more clearing off on South Pennsylvania and Hays Street.

AIRPORT HANGAR LEASE

Wes Hughes presented a Lease format for updating the Hangar Lease Agreement. He wants to buy Dusty Linn’s hangar and needs an extended term for a lease. The format was discussed and a work session will be scheduled. Charge per Lease will have to be determined. Any available maps of the hangar areas would be good.

March 16th is target date set for a new Lease to be approved.

REQUEST TO PAINT ADDRESS NUMBERS ON CURBS

Lateith McVea was present to request permission to solicit painting address numbers on the City curbs. The Commission consensus said it was a good idea. Information to the public will indicate that painting on curb does not take place of requirement to have address numbers on residence.

INDUSTRIAL DEVELOPMENT BOARD REQUEST FOR I.D. BUILDING

Jerry Turner, Marilyn Downing and Don Jensen were present to request that the City hold off on putting a concrete floor in the Industrial Development Building. The I.D. Board is pursuing a new avenue as a local person may be interested in having the building. The consensus of the City Commission is to wait until March 2nd.

REQUEST AREA FOR DIRT BIKE TRACK

Brandon and Gary Gerber were present to request the use and lease of the City’s 52.71 acres of south pasture land for a Dirt Bike Track. They have been researching insurance coverage and have talked to Zeb Prawl about taking over the Lease. Prawl indicated he would have no objection and would release Lease. They discussed having a fence and leasing the land for a dollar. Will proceed with paper work.

FINDINGS OF FACT AND ORDERS – 210 N. JEFFERSON

Mayor Hatfield read Findings of Fact for abatement of Health Nuisance and Inoperable Vehicle for the property at 210 N. Jefferson addressed to Irmal Irene Hays and other owners.

Mayor Hatfield made the motion that the City accepts the Findings of Fact and issues the Orders for the abatement of Health Nuisance and Inoperable Vehicle and assessing of the expense thereof for the property at 210 N. Jefferson addressed to Irmal Irene Hayes and others, 174 e. State Rd 44. The motion was seconded by Commissioner Hammersmith. Motion carried, 4-1 with Commissioner Hekel voting no.

FINDINGS OF FACT AND ORDERS – 208 N. JEFFERSON

Mayor Hatfield read the Findings of Fact for the abatement of the Health Nuisance and assessing of the expense thereof for the property at 208 N. Jefferson, addressed to Robert M. and L. Jean Thomas, 422 NW 10 Ave, Anthony, Kansas.

Commissioner Williams made the motion that the City accepts the Findings of Fact and issue the Order for the abatement of Health Nuisance and assessing of the expense thereof for the property at 208 N. Jefferson addressed to Robert M. and L. Jean Thomas 422 NW 10 Ave. Anthony, Kansas. The motion was seconded by Commissioner Hekel. Motion carried.

FINDINGS OF FACT AND ORDERS – 203 N. MADISON

Mayor Hatfield read the Findings of Fact for the abatement of the Health Nuisance and assessing of the expense thereof for the property at 203 N. Madison, addressed to Aaron Bonham and Heather Bonham 602 E. Washington, Anthony, Kansas.

Mayor Hatfield made the motion that the City accepts the Findings of Fact and issue the Order for the abatement of Health Nuisances and assessing of the expense thereof for the property at 203 N. Madison, addressed to Aaron Bonham and Heather Bonham, 602 E. Washington, Anthony, Kansas. The motion was seconded by Commissioner Hekel. Motion carried.

SOUTH VERMONT PROPERTIES

Commissioner Hekel commented on the Letter to the Editor in the Anthony Republican about the condition of the property on S. Vermont. Officer Hodson said he had been in contact with the owners and they are in the process of cleaning it up.

FIRE DEPARTMENT REPORT

Fire Chief Hodson discussed with the City Commission about applying for FEMA Grants. One for gear: boots, helmets and coveralls for fighting grass fires and a Grant Application for a new tanker truck to replace the 1980 International Truck purchased from the State Highway Department. It was consensus of the City Commission to go ahead and apply for FEMA Grants.

ORDINANCE NO. G – 2751

AN ORDINANCE AMENDING CHAPTER XVII, UTILITIES ARTICLE 2. INSIDE CITY LIMITS OR WITHIN THREE MILES OF ANTHONY CITY LIMITS.

Commissioner Hekel made the motion that the City adopts Ordinance NO. G-2571. The motion was seconded by Commissioner Hammersmith. Motion carried 4-1, Commissioner Dickey voting no.

ORDINANCE NO. G – 2752

AN ORDINANCE AMENDING CHAPTER XVII, UTILITIES ARTICLE 2. OUTSIDE OF THREE MILES OF THE CITY LIMITS OF ANTHONY.

Commissioner Hekel made the motion that the City adopts Ordinance NO. G-2572. The motion was seconded by Commissioner Hammersmith. Motion carried.

CDARS PROGRAM

After discussion, Commissioner Hekel made the motion that the City Clerk/Administrator be authorized to sign an agreement for the City of Anthony to use the Certificate of Deposit Account Registry Service (CDARS) Program through KANZA Bank. The motion was seconded by Commissioner Hammersmith. Motion carried by Roll Call vote. Yeas: Hekel, Hammersmith, Hatfield and Dickey. Nays: None. Abstentions: Williams.

LAKE RESOLUTION FEE

The City Commissioners discussed the changes recommended by the Anthony Lake Board. The Commission agreed with the new camping fees recommended but would like to have the requirement to leave the Lake property after 14 consecutive days, stay the same, with wording being changed. A new Resolution will be drawn up and the Lake Board Chairperson will be notified.

DRUG AND ALCOHOL TESTING

Program Information for employee Drug and Alcohol Testing from THC was presented. The City Commission will review the information for discussion.

HARPER COUNTY ECONOMIC DEVELOPMENT COUNCIL

Mike Lanie will come to the next meeting to discuss Mike Carmichael’s resignation from and the request to appoint Kyle Clark, to the County Economic Development Council.

CHIEF OF POLICE REPORT/DOMESTIC DISTURBANCE/COUNTERFEIT 50’S/POWDER GUN AT GUN CLUB

Chief Blevins reported that they had responded to a Domestic Disturbance in the 400 block of West Vine. Suspect taken into custody. Case taken to County Attorney.

Responded to a Disturbance in the 400 block of South Lincoln. Two persons taken into custody. Case taken to County Attorney.

Investigated a Counterfeit $50 passed. It had been passed at a local business.

Commissioner Hekel reported that he had been contacted by a Lake Resident that thought a Powder Gun was being used at the Gun Club. The Gun Club will be contacted.

CITY SUPERINTENDENT REPORT/ENTRANCE FOR LEAR PROPERTY/STIMULUS NOT SO MUCH/LEPC MEETING/SEWER CAMERA/STREET SIGNS/TENNIS COURT/ALLEY WAY/SEPTIC SYSTEM AT POWER PLANT

Superintendent Sechler reported that Data Tech was here and he thought changes in billing can be made.

A letter from KDOT indicated that an entrance on K-44 for Mary Lear could probably be made.

Don Hellar of EBH reported that KDHE Stimulus Program might not be as good as anticipated. He wanted to know if anyone still wants to go to Kansas City to examine.

He will attend the Local Emergency Planning Committee (LEPC) Meeting on Wednesday.

Baker Equipment should be here to demonstrate and train for the use on the Sewer Camera.

The septic tank and laterals for Sewer System at Power Plant are installed. Two houses are hooked up.

COMMISSIONERS COMMENTS

The Commission asked about new Street Signs and the downtown Tennis Court curb.

The alley gutter by Post Office needs concrete.

CITY CLERK/ADMINISTRATOR REPORT/J-TURN ORDINANCE/MINERAL RIGHTS//PASTURELAND LEASE/NEW BILLING INFORMATION/CITY INFORMATION ELECTION

The City Clerk/Administrator reported that the J-Turn Ordinance is still being reviewed.

He has not found any information about mineral rights for the first parcel of land purchased by Mike Anderson. He has checked with Terry Messick. Commissioner Williams said that the title insurance papers should be checked.

Will proceed for the release of the Pastureland Lease with Zeb Prawl.

Customer concerns about Fuel Adjustment. They believe something ought to be put in the newspaper. The Commission was in consensus to have information placed in the paper about new billing and energy charge before the next billing cycle.

Also, some information about the up-coming Election should be put in the newspaper.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
