The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Barbara Muse presiding and the following Commissioners present: Hall, Tedder, Hammersmith, and Dickey. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Jim Forsyth and Cynthia Clark.
Pastor Mary Hixson of the Episcopal Church gave the Invocation.
Mayor Muse made the motion to approve the minutes of the previous meeting. The motion was seconded by Commissioner Tedder. Motion carried.
APPROPRIATION ORDINANCE
Claim Ordinance #5601 making appropriation for $55,714.07 for the payments of certain claims against the City of Anthony for appropriation ordinance was presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.
EXECUTIVE SESSION
Mayor Muse made the motion that the City Commission go into Executive Session for 15 minutes for consultation with the City Attorney on matters that would be deemed privileged in an Attorney-Client Relationship. The motion was seconded by Commissioner Dickey. Motion carried.
At 8:32 a.m. the City Commission room was cleared with City Attorney Jim Forsyth, Public-Health Officer Kenny Hodson, Donna Crowe, Police Chief John Blevins, City Superintendent Sechler and City Administrator Don Heidrick remaining. At 8:47 a.m., the Mayor called the meeting back into regular session. No decisions were made.

COMMENTS FROM THE PUBLIC
Cynthia Clark asked if Wheatland Electric had been contacted about Electric rates. Mayor Muse stated Greg Wilson of 21st Century Management had been hired to look into rates from different Electric Companies.
ORDINANCE NO. G-2756
AN ORDINANCE REGULATING TRAFFIC AND AUTHORIZING THE OPERATION OF MICRO-UTILITY TRUCKS WITHIN THE CORPORATE LIMITS OF THE CITY OF ANTHONY, KANSAS; INCORPORATING BY REFERENCE THE “2008” STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES, 36TH EDITION, WITH CERTAIN CHANGES AND ADDITIONS; PRESCRIBING ADDITIONAL REGULATIONS; PROVIDING CERTAIN PENALTIES; AND AMENDING ORDINANCE NO. G-2748 OF SAID CITY.
Commissioner Hall made the motion that the City adopts Ordinance No. G-2756. The motion was seconded by Commissioner Hammersmith. Motion carried.
ORDINANCE NO. G-2757
AN ORDINANCE MAKING IT UNLAWFUL TO OPERATE ALL-TERRAIN VEHICLES AND OFF-ROAD VEHICLES ON ANY STREET WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF ANTHONY, KANSAS AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF.
Commissioner Hall made the motion that the City adopts Ordinance No. G-2757. The motion was seconded by Commissioner Tedder. Motion carried.
FINDINGS OF FACT – 208 AND 210 E. MAIN – ISSUE ORDER
Mayor Muse read the Findings of Fact regarding an Inoperable Vehicle Nuisance at 208 and 210 East Main. Commissioner Dickey made the motion that the City accepts the Findings of Fact and issue the Order for the abatement of the Inoperable Vehicle Nuisance at 208 and 210 East Main to Williams V. and May C. Wright, 280 Fairway, Wichita, Kansas. The motion was seconded by Commissioner Tedder. Motion carried.
2010 BUDGET DISCUSSION – CITY CLERK/ADMINISTRATOR REPORT
Mayor Muse reported the Library Budget for 2010 had been received. City Administrator Don Heidrick reported he had trimmed the 2010 Budget as discussed at the Workshop on Thursday. The City Commission was in agreement to trim 3 mills from the Budget which is 26,175. $15,175 trimmed from the Street Department Budget; $6,000 from the Fire Department; $2,000 from General Administration; $1,000 from the Police Department and $2,000 from Employee Benefits.
The City commission was concerned about the amount trimmed from the Street Department. It is hoped that sufficient revenue will be available in the Special Street and Highway Fund to supplement any Street Department shortages. The Municipal Equipment Fund could be transferred back to General Operating if necessary.
FIRE AFTERMATH
City Clerk/Administrator Don Heidrick reported that Donna Crowe continues to work on the Urgent Need Grant Application. She is currently waiting on Environmental Reports.
REQUEST TO HARPER COUNTY COMMUNITY FOUNDATION FOR THE RETURN OF WAYNE DENNIS FUND MONEY
Commissioner Tedder made the motion that the City requests the return of $250,000 that had been provided to Anthony Community Foundation now known as the Harper County Community Foundation from the Wayne Dennis Fund. The motion was seconded by Commissioner Hammersmith. Motion carried.
KLINK PROJECT
City Superintendent Sechler reported on a 2012 KLINK Project Application for Kansas Highway 179 from Main St. to the South City limits. For mill overlay, cost to the City would be $206,621.00. The City would have to pay 25% plus cost for pre-construction engineering. It could be spread over a 2 year period. Cost to the City would be $130,000 to $150,000 over the 2 year period.
Commissioner Dickey made the motion that the City apply for the 2012 KLINK Project Grant for KS Highway 179, from Main St. to the South City limits to be extended over two years. The motion was seconded by Commissioner Tedder. Motion carried.
CITY SUPERINTENDENT REPORT/COMMUNITY SERVICES PROGRAM FOR CITY CEASES/CITY CREWS BUSY/ROOF DAMAGE-FISH FOOD SHED/WORKING ON BUDGET/FIRE ISSUES
The Community Services will no longer be available to help the City mow the properties, because they involve private properties. Thanks to Cecilee Downing for what has been done.
The City crews have been working on Water/Wastewater Projects, replacing poles from storm damage, house moving/clearing ditches, grading and mowing.
Shingles blew off the building at the Lake that they store fish food in, from one of the wind storms. Wildlife and Parks will pay for the repair of the roof.
Working on Budget items and Fire issues.
CHIEF OF POLICE REPORT/MICRO-UTILITY VEHICLES/RODEO PARADE/INVESTIGATING CASES
Chief Blevins had reported on the Micro-Utility and All-Terrain Vehicle/Off Road Vehicle Ordinances.
Matthew Schultz went to Attica for the Rodeo Parade in the Marked Unit.
Assault in the 100 Block of W. Grant, Juvenile taken into custody and taken to Hutchinson.
Investigating a Case from the 200 block of N. Santa Fe., involving a disagreement of three individuals. Case to the County Attorney.
Mayor Muse made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
