The Board of Commissioners of the City of Anthony, Kansas met in regular session at 6:00 p.m. with Mayor Barbara Muse presiding and the following Commissioners present: Dickey, Hammersmith, Hall, and Tedder. Absent: None. Also present were Donald F. Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Shawn Catlin of the Harper County Herald; Daniel Levens, Mary Hixson, J. D. Hays, Charles Coggins, Jeanne Barber, Creighton Cullop, Mark Pfeiffer, Mitchell Hall, Ron Poor, Howard Hatfield, Buford Curry, and Gwen Warner.

The Invocation was given by Mike McAbee of the Assembly of God Church.

Mayor Muse made the motion to approve the minutes of the previous meeting. The motion was seconded by Commissioner Tedder. Motion carried.

Mayor Muse made the motion to approve the minutes of the Special Meetings of ­­­­­­­­­May 26th and June 2, 2010. The motion was seconded by Commissioner Tedder. Motion carried.

APPROPRIATION ORDINANCES and 05/18/10 and 06/08/10 PAYROLLS APPROVED

Claim Ordinance #5634 making appropriation for $244,980.93 and Claim Ordinance No. 5635 making appropriations for $329,290.36 for the payment of certain claims against the City of Anthony for appropriation ordinance and $46,071.33 for 05/18 Payroll and $49,805.80 for 06/08 Payroll were presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance and payroll were unanimously approved and claims ordered paid.

PUBLIC COMMENTS

Mary Hixson was concerned that the City Commission when the City held a meeting to decide on not to pursue the City Manager type of government. The Commission expressed that the item did not come up on the Agenda. No one officially came to discuss the matter at a City Commission Meeting. It was discussed in a letter and information received from Ron Poor and the Chamber of Commerce. The City Commission decided at this time there was too many other issues and projects facing the City and it could be covered at a later time. Howard Hatfield and J. D. Hayes expressed they were against seeing any change at this time.

Creighton Cullop expressed appreciation to the City crews for the work they did at the Lake before Memorial Day.

Playground equipment needs to be moved yet.

NEW POLICE OFFICER – DANIEL LEVENS

Chief Blevins introduced Officer Daniel Levens as the new Police Officer. He passed the Challenge Exam and Firearms Qualification at KLETC.

MARK PFEIFER COMMENTS

Mark Pfeifer did not appreciate the City’s comments at the last City Commission Meeting regarding the wrecked cars on his property. He did not know the Walker family was going to be at the Meeting. He had been working with Grant for some time to get a fence put up. He is ready to go forth with the project.

ADVERTISING FOR LAKE MAP

Buford Curry asked the City Commission’s permission to sale advertising ads for a Lake Site Map Brochure. The City Commission did not object. Commissioner Hall made the motion that the City allow Mr. Curry to sale ads. The motion was seconded by Commissioner Hammersmith. Motion carried. The City would need to sign an Agreement to allow it for 5 years.

Later, Creighton Cullop returned and expressed concern that the Agreement would not allow other advertising for the Lake. The City Commission decided to let the City Attorney review the Agreement before having the Mayor sign it.

MASSACHUSETTS STREET

J. D. Hayes recommended the area which has been used as extension of Massachusetts Street to Hayes Street, which is on private property, be opened by the City for public use. No decisions were made.

RESOLUTION NO. 770

A RESOLUTION AUTHORIZING THE PUBLIC OFFICERS OR OTHER AGENTS

OF THE CITY TO ABATE HEALTH NUISANCES AS AUTHORIZED BY

ARTICLE 2 OF CHAPTER VII OF THE CITY OF ANTHONY CITY CODE.

Commissioner Dickey made the motion that the City Commission adopts Resolution NO. 770. The motion was seconded by Commissioner Hammersmith. Motion carried.

RESOLUTION NO. 771

A RESOLUTION AUTHORIZING THE PUBLIC OFFICERS OR OTHER AGENTS OF THE CITY TO ABATE INOPERABLE VEHICLES AS AUTHORIZED BY ARTICLE 3 OF CHAPTER VII OF THE CITY OF ANTHONY CITY CODE.

Commissioner Dickey made the motion that the City Commission adopts Resolution NO. 771. The motion was seconded by Commissioner Hammersmith. Motion carried.

DOWNTOWN REBUILDING COMMITTEE/CITY DEVELOPER/

CID HAS TO BE ESTABLISHED

Members of the Downtown Rebuilding Committee were present to request the City be the developer. Having City Bonding authority for the Downtown Rebuilding Project.

Commissioner Tedder made the motion to amend the City’s action from the October 26, 2009 Meeting and the Downtown Rebuilding Committee have 7 members to serve terms of two years effective from today, and not be required to have a 501(3)C Organization. The motion was seconded by Commissioner Hall. Motion carried.

Commissioner Tedder made the motion that the City be developer, provided

CID is approved and established and funding is available. The motion was seconded by Commissioner Hall. Motion carried.

CHIEF OF POLICE REPORT/FOURTH OF JULY MEETING/

ATTENDED THE KANSAS INTELLIGENCE ASSOCIATION MEETING/TASERS/

LAKE CAN CLOSE FOR SPECIAL EVENTS/STOP LIGHTS ON CAUTION FOR HARVEST

Chief Blevins reported he had attended the 4th of July Planning Meeting. He also attended the Kansas Intelligence Association Meeting in Kingman.

He ordered two more Tasers with funding from the County Attorney.

Kansas Wildlife and Parks reported the Lake according the Kansas Statutes, may be closed up to 5 days for special events.

Notice needs to be put in the paper that the Lake will be closed to boating and swimming on Saturday, June 12th for the Muddy Water Music Festival.

Stop lights will be changed to caution at Kansas and Springfield for Harvest.

RURAL DEVELOPMENT – JUNE 10TH/

LIGHTS FOR WAYNE DENNIS PARKING LOT/

PROBLEMS WITH NORTH TENNIS COURTS

Mayor Muse read the City Superintendent’s Report. Jim Forsyth, Don Hellar and he met with appraisers on the Harper County land May 27th. The Hearing will be June 9th at 6:00 p.m. at the Courthouse. They also met appraisers on the property in the south end of Anthony, May 28th. The Public Hearing on the property is June 10th at 1:30 p.m.

He has been working with Mark Pfeifer on his property.

He attended the KMU Directors Meeting in McPherson on Thursday and Jim Forsyth at 4:00 p.m. on the same day.

After painting and getting the pool filled, we are hoping to have the pool opened by June 19th.

Regulators and Transformers for the Power Plant should be delivered the last week of June and/or the first week of July.

The Power Plant had to generate on the hot days.

Meeting with Rural Development is June 10th at 3:00 p.m. in the City Commission room.

The light poles for the Wayne Dennis Parking Lot will be in on Sunday. He will meet with suppliers and help unload them.

There are problems with the North Tennis Courts again. Post tension technicians from Texas came. Contractors are willing to correct the problem.

CITY CLERK/ADMINISTRATOR REPORT/2011 BUDGET

He reported he has been working on Employment verification for the City Clerk/Administrator position.

He has asked the Auditors to do the 2011 Budget because of the City Clerk/Administrator change.

EXECUTIVE SESSION

Mayor Muse made the motion that the City Commission go into Executive Session for 30 minutes with non-elected personnel.

At 7:10 p.m. the City Commission room was cleared with City Clerk/Administrator Heidrick and Kurtis Jacobs remaining. At 7:40 p.m., Mayor Muse called the meeting back into regular session. No decisions were made.

CITY CLERK/ADMINISTRATOR CONTRACT

Commissioner Tedder made the motion that the City, pending a Professional Contract, will hire a new City Clerk/Administrator. The motion was seconded by Commissioner Hall. Motion carried.

Mayor Muse made the motion that the City Commission reconvenes the meeting for June 10, 2010, at 3:00 p.m. to finish business. The motion was seconded by Commissioner Tedder. Motion carried.

RECONVENED JUNE 7, 2010 REGULAR MEETING – JUNE 10, 2010 AT 3:00 P.M.

The Mayor reconvened the June 7th Meeting. All Commissioners were present along with Philip Fishburn of Midwest Assistance, Tom Finger of Rural Development, Don Hellar of EBH, John Haas of Ransom Financial, City Superintendent Grant Sechler, and City Clerk/Administrator Don Heidrick.

COMMENTS – WATER IMPROVEMENT PROJECT

Phil Fishburn of Midwest Assistance emphasized the importance that the City follows through with the project now. Superintendent Sechler commended Fishburn’s efforts to accomplishing the progress of the project.

EBH COMMENTS

Don Hellar of EBH read over the items of the Water System Improvements Project and cost. Total project cost is $8,900,000. Rural Development Grant Funds totaling $3,902,000 and Rural Development Loan for $4,998,000.

RURAL DEVELOPMENT

LETTER OF CONDITIONS – INITIAL PAPERS – WATER SYSTEM IMPROVMENTS

Tom Finger of Rural Development read the Rural Water Letter of Conditions for the Water System Improvements Project. After going through it, the City needed to approve the initial paperwork.

Commissioner Tedder made the motion that the City proceeds with the Water System Improvements through Rural Development and authorize the Mayor and City Clerk to sign all related necessary forms for the Water System Improvements. The motion was seconded by Commissioner Hammersmith. Motion carried.

RANSON FINANCIAL

Commissioner Tedder made the motion that the City approves Ranson Financial to do the Water Rate Check-up which will be financed by EPA and KDHE. The motion was seconded by Commissioner Dickey. Motion carried.

Mayor Muse made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Hammersmith. Motion carried.
