The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Barbara Muse presiding and the following Commissioners present: Hall, Hammersmith, Dickey and Tedder. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Cynthia Clark, Kenny Hodson, Terry Stark, Jim Forsyth, Dick Busby, Cecelia Downing, Marilyn Downing, Rick Baldwin, Marilea Struble, and Paul Jefferis.

Mr. Richard Busby of the Freeport Presbyterian Church gave the Invocation.

Commissioner Tedder made the motion to approve the minutes of the previous meeting. The motion was seconded by Commissioner Hammersmith. Motion carried.

APPROPRIATION ORDINANCE and 05/12/09 PAYROLL APPROVED

Claim Ordinance #5590 making appropriation for $47,796.37 for the payments of certain claims against the City of Anthony for appropriation ordinance and $48,523.13 for 05/12 Payroll were presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance and payroll were unanimously approved and claims ordered paid.

WATER/WASTEWATER DEPARTMENT REPORT

Terry Stark, Water/Wastewater Department Head gave a report about the work being done by his Department.

They have worked on the lateral field on the East side of Lake. Cleaned septic tanks at the Gun Club and Golf Course. Cleaned several Sewer lines. Park Restrooms are open. Large section of 6’ chain link fence is down behind the Sewer Plant due to flooding.

On the Water side, repaired chlorine analyzer. Installed Water heaters at Campsite A restrooms. Cleaned pool and filled it with Water. They are installing lifeguard platforms and new pump on slide. Attended the KDHE – KRWA Water Meeting with Commissioner Hall. Mowing and general maintenance.

PROPERTY CLEAN-UP BIDS

Officer Hodson reported Clean-up Bid proposals for 623 N. Lincoln property are $850 from Wyatt Trash and $1200 from Haul R’ Us and for 124 N. Lincoln; $450 from Wyatt Trash and $600 from Haul R’ Us.

Mayor Muse made the motion that the City accepts the Bids from Wyatt Trash for the property Clean-up at 124 N. Lincoln and 623 N. Lincoln. The motion was seconded by Commissioner Hall. Motion carried.

EMC DIVIDEND CHECK

Marilea Struble and Paul Jefferis from Strong’s Insurance presented a Dividend Check for $14,764.00 for the insurance year April 2007-March 2008

PROPERTY CLEAN-UP ORDER – 218 SOUTH KANSAS

Mayor Muse read the Findings of Fact regarding the Health Nuisance for 218 S. Kansas. Commissioner Dickey made the motion that the City accepts the Findings of Fact and issue the Order to Charles Redfern and Others for the abatement of Health Nuisance for an empty lot at 218 S. Kansas. The motion was seconded by Commissioner Hall. Motion carried.

PROPERTY CLEAN-UP ORDER – 208 N. LINCOLN

Mayor Muse read the Findings of Fact regarding a Health Nuisance for 208 N. Lincoln. Commissioner Dickey made the motion that the City accepts the Finding of Facts and issue the Order to Monty Hess for the abatement of Health Nuisance for the property at 208 N. Lincoln. The motion was seconded by Commissioner Hall. Motion carried.

PROPERTY ON SOUTH PENNSYLVANIA

Rick Baldwin asked about the availability of the property on South Pennsylvania; South of the new Atmos Building for his trucking. The Commissioners previously had indicated the property would be available if something was constructed on it within so many years. The Mayor and Commissioners said they would make a decision by June 15th.

FLOOD INSURANCE

An Administrator needs to be designated for the Flood Insurance Program for the City. Leroy Leland is Administrator for the County and could possibly do it for the City. The Commission would like to know pros and cons for having the County Administrator involved with the program.

CHIEF OF POLICE REPORT/DISTURBANCE AT SMOKEHOUSE/COMPLAINT THREAT/BALLOON FEST

Chief Blevins reported that they were called to a disturbance at the Smokehouse Club. One person taken into custody for battery and obstruction of justice.

Investigating threats complaint in the 300 block of South Kansas.

On behalf of the Balloon Fest Committee, he thanked everyone involved, Grant and City crews for preparation, Kiwanis Club for parking, CERT people for help with the Asphalt Cowboys and Donna Crowe for the parade.

He will be attending a joint Law Enforcement Conference in Topeka.

EXECUTIVE SESSION

Mayor Muse made the motion that the City Commission go into Executive Session for 15 minutes to discuss matters considered confidential in an Attorney/Client relationship, with the City Officers and City Attorney remaining. The motion was seconded by Commissioner Dickey. Motion carried. At 9:15 a.m., the Commission room was cleared with the City Officers and City Attorney remaining. At 9:30 a.m., the Mayor called the meeting back into regular session. No decisions were made.

BALMER FUND

City Attorney Jim Forsyth informed the Commission on the ensuing court case with the Balmer Fund for the demolition of their Building on W. Main Street.

BELLESINE LAKE LOT

City Attorney Jim Forsyth questioned moving forward with the Lake Lease issue with Steve Bellesine, since he decided not to build on his Lake Lot. The City Commission will be open to working with banks and mortgage companies for the Lake Lease holders in the future.

FIRE STATION DOORS

Fire Chief Hodson reported on the damage to one of the two front doors in the South portion of the Fire Station. City Insurance will pay for it after the deductible. The Fire Department would like to purchase the other door so the two doors will match. He had a proposal from Cheney Door Co. for $7,165. Money to finance will come from left over borrowed Fireman’s Relief money and remaining estate money.

Commissioner Hammersmith made the motion that the City purchases two new front doors as proposed for South portion of the Fire Station Building. The motion was seconded by Commissioner Dickey. Motion carried.

CITY SUPERINTENDENT REPORT/KANSAS POWER POOL MEETING/KMU CONFERENCE/VOLUNTARY ASSESSMENT/HIGHWAY SAFETY AUDIT

Superintendent Sechler reported that he, Commissioner Hall and Larry Berry attended a Kansas Power Pool Meeting in Wichita last Wednesday. It will take 6-8 months to find out availability of transmission from different power sources. The City would need to be a member of K.P.P. before they would start on this. It would cost around $1700.

They also attended the KMU Conference last week. He has information from KMEA asking for Voluntary Assessments for member Cities to help fund a complaint from some West Star Cities. He received a Highway Safety Audit from KDOT. They would like comments by June 1st.

K.P.P. STUDY

After discussion, Commissioner Hall made the motion that the City participates in the K.P.P. Study for approximately $1700. The motion was seconded by Commissioner Tedder. Motion carried.

POWER DISCUSSION

Commissioner Tedder expressed his hope the City could become self-sufficient for Electric Power, using wind generated power and the Power Plant and have Power pool for back-up.

Superintendent Sechler will try to get someone to come who is not selling wind power.

CITY CLERK/ADMINSTRATOR REPORT/TAX ASSESSMENTS/QUORUM DISCUSSION/TAXI POLICY/PROMISSORY NOTE

City Clerk/Administrator Heidrick reported he had been conversing with John Haas of Ranson Financial Consultants about Tax Assessments for the Bond issue for the Wheatridge, Visions, and Tennis Court Projects.

Will place Quorum discussion on the Agenda for May 18th, 2009. Will have information on the Taxi Policy. He has information for using Collection Agency to collect past due accounts.

He had provided copies of Promissory Note with George Von Valkenburg Jr. and Major Weiss as Power Marks Associates. Interest payment is due in June.

WORK SESSION

The Mayor called the Work Session Meeting to order at 5:30 p.m. with members of City Commission and members of Golf Course Board. Discussion was held regarding ways the City might be able to help with the expenses for the operation of the Golf Course. Several avenues will be investigated. No decisions were made. The Mayor closed the Work Session.

Mayor Muse made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Hammersmith. Motion carried.
