The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 A.M. with Mayor Hatfield presiding and the following Commissioners present: Hekel, Hammersmith, Dickey, and Williams. Absent: None. Also present were Donald F. Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of The Anthony Republican; Kenny Hodson, Terry Stark, Jeff Parsons, Dick Rasmussen, and Creighton Cullop.

The minutes of the previous meeting were approved.

APPROPRIATION ORDINANCE AND 5/15 CITY PAYROLL APPROVED

Claim Ordinance #5488 making appropriations for the payments of certain claims against the City of Anthony in the sum of $95,784.24 for appropriation ordinance and 5/15 City Payroll for $41,896.54 were presented and on motion by Commissioner Williams, seconded by Commissioner Dickey, said ordinance and 5/15 City Payroll were unanimously approved and claims ordered paid.

WATER/WASTEWATER DEPARTMENT REPORT

Terry Stark, Water/Wastewater Department Head, reported the control panel at the Garfield Lift Station had been installed. One of the Power Plant Houses needs the septic tank cleaned. The Commission discussed having a pressurized system. Commissioners were in consensus that cost for a system will be considered. They are cleaning the lines between the Sewer Plant ponds.

They repaired a couple more leaking water meters. Swimming Pool needs a few tiles replaced. A couple of leaking shower handles need repaired. The Pool should be ready to fill. They will be installing a testing valve at the first water service on the main line.

ATMOS GAS FRANCHISE

The City Commission discussed the proposed Atmos Gas Franchise. After indicating several changes, Mayor Hatfield said he could deliver a copy to Atmos with the proposed changes, as discussed by the Commission.

OIL AND GAS FRANCHISE BID

One bid was received for oil and gas lease of City property east of town by the City landfill submitted by Agents for Lessees Jeff Parsons and Dick Rasmussen for $854.40 for three years.

Commissioner Williams made the motion that the City accept the oil and gas bid from Jeff Parsons and Dick Rasmussen as agents for lessees for $20 an acre for $854.40 for three years for the land east of Anthony for property described in said oil and gas bid. The motion was seconded by Commissioner Hekel. Motion carried, Mayor Hatfield abstaining.

WATER IN CABIN

Creighton Cullop reported water had gotten into his cabin from the rains last weekend. He had found tubes plugged. He thanked Grant for help. Lake person needs to check tubes.

TELEPHONE FRANCHISE

The City Commission began discussion about the telephone franchise which is up for renewal after this year. Commissioner Williams indicated he would like to review the present franchise. Copies of present franchise will be given to Commissioners for review with the proposed new franchise.

CONTRACT FOR CONSTRUCTION ENGINEERING FOR GEOMETRIC PROJECT

KDOT has sent contract papers for Construction Engineering with EBH for the Geometric Project.

Commissioner Williams made motion for the City accept the Contract for Construction Engineering Inspection By Consultant with Evans, Bierly, Hutchison & Associates, P.A., as consultant with KDOT Secretary as agent for the City of Anthony, local public authority. The motion was seconded by Commissioner Dickey. Motion carried.

RESOLUTION NO. 683 ADOPTED

A RESOLUTION AUTHORIZING THE GOVERNING BODY OF THE CITY TO FIX A TIME AND PLACE AT WHICH THE OWNER, THE OWNERS AGENT, ANY LIENHOLDER OF RECORDS AND ANY OCCUPANT OF THE STRUCTURE MAY APPEAR AND SHOW CAUSE WHY THE STRUCTURE SHOULD NOT BE CONDEMNED AND ORDERED REPAIRED OR DEMOLISHED AS AUTHORIZED BY ARTICLE 5 OF CHAPTER VII OF THE CITY OF ANTHONY CITY CODE, referring to Lots 10 & 11 in Block 28 in the City of Anthony, Kansas, Harper County, Kansas – 201 North Jefferson, Owner of Record being Gary Bohnert.

Commissioner Hekel made the motion to adopt Resolution No. 683 to set Public Hearing for a dangerous structure for Lots 10 & 11 in Block 28 in the City of Anthony, Kansas, Harper County, Kansas, 201 North Jefferson, belonging to Gary Bohnert, 7 SE 120 Ave., Bluff City, KS 67018, for June 25, 2007 at 9:00 A.M., in the City Commission room, 124 South Bluff, Anthony, KS. The motion was seconded by Commissioner Hammersmith. Motion carried.

ORDER

Mayor Hatfield made the motion that the City of Anthony send an Order to Gary L. Bohnert, 7 SE 120 Ave., Bluff City, KS 67018 to abate a Health Nuisance for 201 North Jefferson, Anthony, KS. The motion was seconded by Commissioner Hekel. Motion carried.

GREENSBURG DISASTER FUND

Commissioner Hekel made the motion that the City donate $5,000 to the Greensburg Disaster Fund which is being administered by the League of Kansas Municipalities. The motion was seconded by Commissioner Hammersmith. Motion carried.

KDOT PROJECTS

KDOT sponsored local transportation programs for KLINK Resurfacing Geometric Improvement projects and Economic Development Projects can be applied for. Redoing the Main Street was discussed along with reapplying for Geometric Improvement projects for East Main and North end on LL&G.

There is also Transportation Enhancement Funding Programs available. Funding would include items in historic category, scenic and environmental category, and pedestrian and bicycle facilities category. The Commission was interested in looking into possible walkway and pedestrian bicycle pathways. He was to check with Donna Crowe.

CITY SUPERINTENDENT'S REPORT / MUTUAL AID / WEST ACRES PROJECT /

GEOMETRIC PROJECT / ATMOS / WATER REPORT / INTERVIEWS /

JAY HALL RESIGNS / DAM INSPECTION

City Superintendent Sechler reported that KMEA had called last Wednesday for assistance in Greensburg. He sent four men, with bucket and digger trucks to work Friday and Saturday. They called again Sunday evening for more assistance for a bucket and digger truck. They will work today and tomorrow.

The West Acres project will be finished today.

The corrected contracts have not been received from KDOT for the Geometric Project.

Atmos will test the gas meters at the Power Plant, Tuesday.

He will be working on a water report for the Sunflower H2O Project and he will be attending a meeting at Medicine Lodge tomorrow night.

Hopefully should have interviews this week.

Jay Hall resigned and gave two weeks notice. His last day will be May 25th, he has accepted position with KanOkla.

Department of Agriculture, Division of Water will be conducting safety inspection of the City of Anthony Dam this inspection year. Funding for the inspection to be paid by them.

COMMISSIONER COMMENTS

Commissioner Hekel mentioned different locations needed for concrete work where concrete has cracked around where water meters were located.

-He mentioned condition of alley back of Methodist Church, pavement had dropped.

-He asked about the flat bed Chevy truck to keep or put up for bids. Could advertise at anytime. It was consensus to keep old dump truck and digger truck. There was discussion if new flat bed was in budget.

-Doors at Municipal Hall are painted and lock needs to be picked up. Mayor talked with Mike Bloomer about handicap front door. City will need to do some electrical work.

-Sidewalk needs to be replaced on North Jefferson where water line was replaced, maybe by Hazel's.

-Sink hole on South Jennings – still there.

-Urinals for Lake are being made.

CHIEF OF POLICE REPORT / METH LAB / HUFF AND SCHULTZ TO TRAINING /

BALLOON FEST GOOD / WEED NOTICES

Chief of Police Blevins reported that meth lab was found at 222 South Madison during investigation of criminal damage to property. KDHE and KBI investigated, with Fire Department and EMS assistance.

Officer Schultz and Huff attended Reid interview and interrogation training last week. This was paid by County Attorney.

Weekend was good for Balloon Fest and events.

Numerous Weeds Notices will be coming because of rain.

COMMISSIONER COMMENTS

-Commissioner Hammersmith asked about junk in 600 North Bluff. Hauled off probably by Wyatt.

-Mayor asked about checking corner Evans and Lincoln – a clear view for driving needed.

-Commissioner Hekel – yield sign may need to be stop sign at Steadman and Jennings because of blocked view.

CITY CLERK/ADMINISTRATOR'S REPORT / TELEPHONE FRANCHISE /

APRIL REPORT / CITY CODE / LATE PAYERS

City Clerk/Administrator Heidrick reported he had copies of present telephone franchise for Commissioners. Angie has April bookkeeping reports completed.

City Code Draft received from League. Commissioner Williams will review.

Late Payers

City Clerk/Administrator asked about with legitimate excuse, if the penalty can be forgiven. Commissioners consensus that City Clerk/Administrator could do that.

He asked about collecting past-due bills from people who live in different county now who left a utility bill here. Setoff has been used. Small Claims would be difficult. A collection agency services will be looked into.

USD #361 / CITY OF ANTHONY CONTRACT LEASE

The City Commission discussed the proposed USD 361/City of Anthony contract for purchase of old football field and lease.

Commissioner Williams made the motion that the City of Anthony approve the contract and Lease with U.S.D. 361 for the old football field on North Springfield after property description is included. The motion was seconded by Commissioner Dickey. Motion carried.

LAST PAYMENT ON FIRST LOAN

Mayor Hatfield informed the City Commission that the Anthony Community Care Center has paid off the first loan made with the City of Anthony for acquiring the Center. A small ceremony will take place Wednesday during Nursing Home Week.

TENNIS COURTS AT POOL

Randy Warner had talked to Mayor Hatfield about the condition of the tennis courts at the Pool. Randy had gotten estimates. Funding was discussed, possibly Wayne Dennis, and/or a bond issue, and school district participation.

S.R.S. OFFICE

Commissioner Dickey asked about the status of the S.R.S. interest in returning to Anthony. Mayor reported that City needs to get proposal together. Richard Shank of AT&T will be contacted for communications. Dale Boice of Don's Printing had been contacted about using part of old KanOkla for office space.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
