The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Barbara Muse presiding and the following Commissioners present: Hall, Hammersmith, Dickey and Tedder. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Kenny Hodson, Mitch Hall, Reta Gates, Mel and Patricia King, Cynthia Clark, Jewell Hall, Ed Preston, and Brandon Gerber.

Ed Preston, Youth Pastor from the Anthony Christian Church gave the Invocation.

Commissioner Tedder made the motion to approve the minutes of the previous meeting. The motion was seconded by Commissioner Dickey. Motion carried.

APPROPRIATION ORDINANCE

Claim Ordinance #5591 making appropriation for $171,343.54 for the payments of certain claims against the City of Anthony for appropriation ordinance was presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.


COMMENTS FROM PUBLIC

Cynthia Clark expressed appreciation for the Lake Road being re-opened after the wash out.

REQUEST THAT SECOND STREET BE OPENED FOR ACCESS

Reta Gates was present to express her request that Second Street be opened north of Spring Street to accommodate the access to properties and utility trucks. After discussion, it was decided to have Superintendent Sechler contact the other property owners as a fence would have to be moved.

QUORUM REQUIREMENT DISCUSSED

The City Commission discussed having a Charter Ordinance be adopted to change the Meeting Quorum to three and repeal Charter Ordinance No. 13 which requires a Quorum of four.

Mayor Muse made the motion that the City repeal Charter Ordinance No. 13 and adopt a new Charter Ordinance to change the Quorum Meeting requirement. The motion was seconded by Commissioner Tedder. Motion carried.

ORDINANCE NO. S-204

AN ORDINANCE VACATING ALL STREETS, AVENUES AND ALLEYS IN SANTA FE ADDITION TO THE CITY OF ANTHONY, HARPER COUNTY, KANSAS AND RESERVING TO THE CITY OF ANTHONY AN EASEMENT TO UTILITIES ON VACATED OAK STREET

After discussion, Commissioner Hall made the motion that the City adopts Ordinance No. S-204. The motion was seconded by Commissioner Tedder. Motion carried.

TAXI POLICY AND PROCEDURES

After discussion, Commissioner Tedder made the motion that the City adopts the Policy and Procedures for the Taxi. The motion was seconded by Commissioner Dickey. Motion carried.

Information and price changes will be given to the riders and published in the newspaper.

DIRT TRACK RIDERS ASSOCIATION REPORT

Brandon Gerber was present to thank the Commission for allowing the Dirt Track to develop. They have 39 members now and the Dirt Track is being used about every weekend.

PUBLIC HEARING – DANGEROUS STRUCTURE – 623 N. LINCOLN

The Mayor closed the regular meeting and opened the Public Hearing at 9:30 a.m. for the Dangerous Structure belonging to Raphael A. and Brandi R. Gehlen at 623 N. Lincoln and Kanza Bank as the Lien Holder.

Mayor Muse read the Findings of Fact for the property as presented by Deputy Chief Hodson. Owners had been served or sent by certified mail the Health Nuisance Notices. Mitch Hall of Kanza Bank was present but had no comments.

Mayor Muse made the motion that the City accepts the Findings of fact for the property at 623 N. Lincoln. The motion was seconded by Commissioner Hammersmith. Motion carried.

Officer Hodson presented an Order for the Abatement of Health Nuisance for 623 N. Lincoln, addressed to Raphael A. and Brandi R. Gehlen.

Mayor Muse made the motion that the City approves the Order for Abatement of Health Nuisance in 30 days for 623 N. Lincoln addressed to Raphael A. and Brandi R. Gehlen. The motion was seconded by Commissioner Dickey. Motion carried.

The Mayor closed the Public Hearing and called the meeting back into regular session.

FINDINGS OF FACT – ORDER – NANCY NGUYEN

Deputy Chief Hodson presented and Mayor Muse read the Findings of Fact and Order for the abatement of Inoperable Vehicle Nuisances at the Anthony Car Impound and located at the City of Anthony Airport, removed from the property of Nancy Nguyen at 417 N. Franklin.

After discussion, Mayor Muse made the motion that the City accepts the Findings of Fact and the Order be issued for the Abatement of Inoperable Vehicles recovered from the property owned by Nancy Nguyen. The motion was seconded by Commissioner Tedder. Motion carried.

COMPENSATORY TIME OFF

The City Commission discussed the pros and cons of Compensatory Time Off in lieu of cash payments for overtime worked. The Commission expressed the opportunity for the City to save money. Police Chief Blevins and City Superintendent Sechler expressed their concern with increased problems with shift work scheduling for the Police Department and getting the work completed in all Departments with personnel having this additional time off along with their Compensatory Time-Off benefits now. Superintendent Sechler had explained that all Water and Line Crews including Department Heads all participate in on-call rotation. Mayor Muse asked why only four Power Plant employees were included in on-call rotation when there are six employees. Superintendent Sechler commented one is the Superintendent and one is a mechanic.

The information on Compensatory time off will be reviewed and a Work Session with Department Heads will be set for Monday, June 8th at 8 a.m.

POLICE CHIEF REPORT/BURGLARY-THEFT AT ELEMENTARY SCHOOL/JOINT-LAW ENFORCEMENT CONFERENCE/COUNTY LAW ENFORCEMENT OFFICERS MEETING

Chief Blevins reported that the Police Department investigated a Burglary-Theft at the Elementary School. He attended the Joint Law Enforcement Conference in Topeka. Good Conference and in-service training. Officers attended the monthly County Law Enforcement Officers Meeting.

CITY SUPERINTENDENT REPORT/VOLUNTARY ASSESSMENT REQUEST/STATE SAFETY AUDIT/DRIVE ENTRANCE REQUEST/KPP MEMBERSHIP/ELECTRIC DISTRIBUTION PRODUCTION DEPARTMENT/STREET DEPARTMENT/EBH – BAR SCREEN/HANDICAP PARKING/WILDLIFE AND PARKS – FISH/LAKE CARETAKER RESIGNED

Superintendent Sechler is seeking more information on the Voluntary assessment request from KMEA.

The deadline for City comments on the State Safety Audits is June15, 2009.

He has received requests for drive entrance off of Cattail Cove at the Lake for a new house.

Paperwork for K.P.P. membership has not arrived yet.

Street Department has been busy mowing, grading roads and cutting trees. They installed a new culvert for the closed East side of Lake Road.

Power Plant has been busy going over all the generators. Kenton Carter was at the Power Plant fine tuning all the generators.

Electric Distribution Department has been working on some new services, helping the Street Department, and general system maintenance.

Wildlife and Parks stocked about 800 pounds of Channel Cat in the Lake last week. They also conducted a fish survey.

He reviewed several fence and building permits this week.

The Lake Caretaker notified him he will be quitting. We will advertise for this position.

COMMISSIONER COMMENTS

Lights for the Housing have been ordered.

The Christian Center would like a Handicap Parking space.

CITY CLERK/ADMINISTRATOR REPORT/FLOOD INSURANCE PROGRAM/CITY LAND SOUTH OF ATMOS BUILDING/CITY MEETING WILL BE TUESDAY/PLAQUE OF APPRECIATION/GOLF COURSE/FINANCIAL REPORTS/COLLECTION AGENCIES

He had contacted I. D. Creech about the County participation in the Flood Insurance Program. He did not know the County was participating. He would get back with him.

He had a call from an interested party for the property South of the new Atmos Building. There will be a request for bids ad in the newspaper.

City Commissioner Meeting next week will be Tuesday, May 26th because the Memorial Day Holiday is on Monday.

He will have a Plaque of Appreciation for Terry Messick for his 37 years on the Anthony Industrial Development board.

He has been contacted by the Kansas Department of Revenue. They said a Lease/Purchase Agreement could be made by the City and the Golf Course. The payment for the Lease/Purchase would be subject to sales tax. The Auditor will assist in determining if and when the Golf Course would have to be designated as a component of the City.

Angie Hartman has completed the April Financial Reports. $100,000.00 was transferred to the Electric Reserve from the Electric Fund.

He will need to review further the Collection Agency information.

NEIGHBORHOOD REVITALIZATION PLAN

After discussion, Commissioner Tedder made the motion that the City approves the Harper County Neighborhood Revitalization Plan Contract. The motion was seconded by Commissioner Dickey. Motion carried. An updated City Zoning Map will be added later.

CONCERNS ABOUT FLOOD INSURANCE ADMINISTRATION

Commissioner Tedder expressed concern with the County managing the City’s flood Insurance Program. The State’s National Flood Insurance Program Specialist will be asked to come to a City Commission Meeting to answer questions.

Mayor Muse made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Tedder. Motion carried.
