The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 A.M. with Acting Mayor David Williams presiding and the following Commissioners present: Hammersmith, Hekel, and Dickey. Absent: Mayor Hatfield. Also present were Don Heidrick, City Clerk/ Administrator; Grant K. Sechler Jr., City Superintendent; Kenny Hodson, Deputy Chief of Police; Amber Schmitz of The Anthony Republican; and Terry Stark, J.D. Hays, Gwen Warner, Jeff Parsons, Dick and Betty Marchant, and Donna Crowe.

The minutes of the previous meeting and special meeting were approved.

APPROPRIATION ORDINANCE APPROVED

Claim Ordinance #5512 making appropriations for $95,749.63 for the payments of certain claims against the City of Anthony for appropriation ordinance was presented and on motion by Acting Mayor Williams, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.

WATER/WASTEWATER DEPARTMENT REPORT

Terry Stark, Water/Wastewater Department Head gave a report on the Water/Wastewater Department.

They have been cleaning sewer lines and lift stations. Alarms have been installed on four of the lift stations. They are waiting on wire so circulators can be relocated on sewer lagoons.

Repairing leak on 18-inch line from Harper. Two leaks on 10-inch line to Power Plant and 2-inch line in front of Sale Barn.

Also five leaky water meters. Cleaned well house, winterized the Park, Ball field and Lake restrooms and the Swimming Pool.

They are installing chlorine analyzer and flow meters at Harper Wells, continuing with installation of alarms and telemetry system.

Commissioner Dickey mentioned the field house at football field needed to be winterized.

Looking into replacing water line on Springfield from Main Street to Evans with 6-inch PVC, 3 fire hydrants and 18 services would cost $18,838.71 plus concrete street repairs and labor. All services were priced using 3/4-inch copper. By using 3/4-inch cts tubing, could save approximately $1,600.00.

Looking at replacing water lines on Jennings from Main Street to Vine and Anthony from Main Street to Vine with 6-inch PVC, 6 fire hydrants, 34 services, would cost $28,523.03 plus concrete street repairs, and labor.

All services were priced using 3/4-inch copper. By using 3/4-inch cts tubing could save approximately $2,200.00.

Acting Mayor Williams would like to look at cost to repair street also where work is done.

BURN PERIOD

Dick and Betty Marchant were present to ask the Commission permission to burn piles of debris. If not have burn period then allow them to burn. Fire Chief Hodson will be asked about allowing the burn.

AIRPORT OIL AND GAS LEASE

Jeff Parsons asked about the City not requesting bid proposals for Oil and Gas Lease at the Airport. The City Commission said that it was not done. The interested parties had looked into doing it several years ago but did not follow through with a proposal.

RESIDENTIAL CHRISTMAS LIGHTS CONTEST

J.D. Hays and Gwen Warner of the Chamber requested participation in the Chamber Residential Christmas Lighting Contest. Last year $100 prizes were given. There was discussion about the collecting of ballots.

Commissioner Hekel made the motion that the City provide 3 prizes of $100 each in electric bill credit for the Residential Christmas Contest. The motion was seconded by Commissioner Dickey.

After discussion, the City Commission agreed to having first prize of $300, second prize of $250 and third prize of $100. The motion was amended and seconded to change the prizes to $300, $250 and $100, in electric bill credit, leaving the balloting collection method to the Chamber. Motion carried.

WAIVER RENTAL FEES FOR ARTS AND CRAFTS SHOWS

J.D. Hays asked also if the City would waiver the rental fees charged for using the Municipal Hall for the Chamber's Sunflower Arts and Crafts Show and also the Christmas Arts and Crafts Show.

Commissioner Hekel made the motion that the City waiver the rental fees for Municipal Hall for the Chamber's Sunflower Arts and Crafts and Christmas Arts and Crafts shows. The motion was seconded by Commissioner Hammersmith. Motion carried.

PLANNING COMMISSION REPORT – ORDINANCE NO. S-193 ADOPTED

Acting Mayor David Williams read the Anthony City Planning Commission Report from the October 18, 2007 Anthony City Planning Commission meeting for Case No. PC 07-03, SU 1, Phil G. Hill, 202/214 S. Jennings. The Anthony City Planning Commission recommended to the Anthony City Commission that a Special Use Permit be granted for self storage units for Lots 1-2-3-4-5 in Block 64 and Lots 6-7 in Block 64 in the City of Anthony.

ORDINANCE NO. S-193 ADOPTED

AN ORDINANCE ISSUING SPECIAL USE PERMIT FOR CERTAIN REAL ESTATE LOCATED WITHIN THE JURISDICTION OF THE CITY OF ANTHONY, KANSAS – 202/214 S. JENNINGS, real estate affected by this ordinance is described as:

(a) Lots 1-2-3-4-5, Block 64, Anthony, Kansas.

(b) Lots 6-7, Block 64, Anthony, Kansas. A Special Use Permit be granted allowing for Self Storage Units.

Commissioner Hekel made the motion that the City adopt Ordinance No. S-193. The motion was seconded by Commissioner Dickey. Motion carried.

AIRPORT PROJECT CHANGE ORDER AND ESTIMATE

Commissioner Dickey made the motion that the City approve the Airport Project Change Order and Final Estimate for the Crackfill and Asphalt Rehab Project for Maxwell Asphalt. The motion was seconded by Commissioner Hekel. Motion carried.

LAKE LEASE TRANSFER

Commissioner Hammersmith made the motion that the City approve the transfer of Lake Lease for Lot 12W from Lisa Ferguson to Charles L. Coggins, Cheris M. Coggins. The motion was seconded by Commissioner Hekel. Motion carried.

RESOLUTION OF SUPPORT

Commissioner Hekel made the motion that the City approve the Resolution of Support for a Kansas Department of Transportation Enhancement Grant for Memorial Park. The motion was seconded by Commissioner Hammersmith. Motion carried.

APPOINTMENT TO ANTHONY BOARD OF APPEALS

Commissioner Hammersmith made the motion that the City appoint James Guy to the Anthony Board of Zoning Appeals to fill the unexpired term of Gary Puls who resigned. The motion was seconded by Commissioner Dickey. Motion carried 3-1, Commissioner Hekel voting no.

DEPUTY CHIEF OF POLICE REPORT / ORDER / HALLOWEEN SAFETY PROGRAM /

VEHICLE LOCATED / USE BUILDING FOR FIRE TRAINING

Deputy Chief of Police Hodson presented an Order for health nuisance abatement.

The Police Department gave Halloween Safety program for Blessed Beginnings and K-1 Classes.

Damage to Police car after someone backing into it.

Located vehicle taken from Daylight Donut Shop. A person taken into custody.

Hodson asked about using the building at the Football Field for Fire Department practice, for training in smoked area.

ORDER – JOSEPH H. WILCOX JR.

Commissioner Hekel made the motion that the City direct and have delivered an Order to Joseph H. Wilcox Jr. to abate health nuisance or request a Hearing. The motion was seconded by Commissioner Hammersmith. Motion carried.

CITY SUPERINTENDENT'S REPORT / STREET PROJECTS /

SEWER MAIN EXTENSION / TENNIS COURTS / K-2/K-44 PROJECT /

SALT WATER DISPOSAL / SILT RETENTION POND

City Superintendent Sechler reported he has been working with contractors for possible street projects.

He should also get estimates for sewer main extension for Sunrise.

He also should have revised bids for tennis courts project. Bond Counsel needs prices by Wednesday.

Grass seeding was completed Friday and striping for K-2/K-44 Project.

He talked to KDHE about proposed salt water disposal south of Harper. KCC handles these cases. They will see if they can have input into it.

Silt retention pond on east side of Lake is complete. Shoreline protection demo on west side will be on Monday, November 12, 2007. West Pond held up on getting land.

He will attend auction that has Bobcat auger and bits listed.

CITY CLERK/ADMINISTRATOR'S REPORT / TAX MONEY / I.D. BOARD MEETING /

SALES TAX MONEY

City Clerk/Administrator Heidrick reported the City received $41,896.17 tax money from the County Treasurer. Received $35,736.45 last year. He reported there is sales tax money that could be used for lowering Bond issue for Street Capital Improvement Projects.

Industrial Development Board should meet at the Smokehouse at 12 Noon for monthly meeting.

WAIVER OF MUNICIPAL HALL RENTAL FEE FOR WARRIOR FOOTBALL BANQUET

City Superintendent Sechler reported that a request was made that the City waive the Municipal Hall Basement Rental Fee for Warrior Football Banquet. Commissioner Hekel made the motion that the City waiver the Municipal Hall Basement Rental Fee for the Warrior Banquet. The motion was seconded by Commissioner Hammersmith. Motion carried 3-0-1 with Commissioner Dickey abstaining.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
