The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 A.M. with Mayor Hatfield presiding and the following Commissioners present: Hekel, Hammersmith, Koeppen, and Williams. Absent: None. Also present were Donald F. Heidrick, City Clerk/ Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of The Anthony Republican; Kenny Hodson, Jim Forsyth, Creighton Cullop, Reta Gates, Teresa Cullop, Steve Wilkinson, Rosalea Hostetler, Jim Lawing, and Gwen Warner.

The minutes of the previous meeting were approved.

APPROPRIATION ORDINANCE APPROVED

Claim Ordinance #5463 making appropriations for the payments of certain claims against the City of Anthony in the sum of $84,534.21 for appropriation ordinance was presented and on motion by Commissioner Williams, seconded by Commissioner Koeppen, said ordinance was unanimously approved and claims ordered paid.

ELECTRIC DISTRIBUTION DEPARTMENT REPORT

Steve Wilkinson, Electric Distribution Department, reported that they need to finish up on the FEMA Street Light Project.

Will put up wooden poles for Christmas lights; do not have time to get steel ones and set.

They will work on the lights at Lake around sidewalk and set two poles at the Airport and change wire for new building. Put in new gas service east of town.

Will attend KMEA meeting. The small utility truck was tested and needs some maintenance.

STEEL FOR CHRISTMAS LIGHT POLES

Commissioner Hekel made the motion that the City accept the low bid from Anderson Welding of $4,012.50 for steel for the poles for the Christmas lights. The motion was seconded by Commissioner Hammersmith. Motion carried.

LAKE BOARD REPORT

Creighton Cullop and Reta Gates were present to discuss with the City Commission about establishing new Lake Lease sites. They proposed selling the rights to leasing lake sites. They would have to build in two years. City Attorney was present and was asked to review the idea. He could not think of any problem but will review.

Commissioners asked the Lake Board to flag the proposed sites. Bid requests for three or four sites at a time would be presented.

REQUEST FOR LAKE LEASE LOT #26W

Creighton Cullop asked for a 20-foot right-of-way to place water line across City property for his Lake Lease. City Commission was in agreement to have a right-of-way agreement drawn up.

He also asked for the City to waive permit charges for construction of new cabin and plumbing and electric. The City Commission did not believe it would be in the best interest of the City to consider the request at this time.

HEARING CONTINUED FOR NANCY NGUYEN PROPERTY

The Mayor reconvened the dangerous structure hearing for the Nancy Nguyen property, 417 North Franklin. City Attorney Jim Forsyth had written Findings of Fact and Order for the property as directed by the City Commission.

Commissioner Williams made the motion that the City adopt the Findings of Fact and issue Order for the owners of the dangerous structure at 417 North Franklin. The motion was seconded by Commissioner Hekel. Motion carried.

FRAZIER BUILDING

Rosalea Hostetler and Attorney Jim Lawing of the Balmer Fund were present to request extension of time to restore the Frazier Building. City Attorney Jim Forsyth gave an oral report on the facts of finding for the structure at 309 West Main in determining it a dangerous structure. The City Commission has made every effort to work with Rosalea Hostetler and the Balmer Fund. He believes due process was followed.

Attorney Lawing requested permission to access the building.

Mayor Hatfield made the motion that the City proceed with the demolition of the building at 309 West Main and request bids. The motion died for lack of a second.

Estimates for demolition will continue to be requested.

CHRISTMAS DECORATION CONTEST

Gwen Warner, representing the Chamber of Commerce Board, asked the City Commission if the City would help sponsor a Christmas lighting contest again, providing prizes for three winners of $100 each off of one month residential electricity for December. Also she asked if the City Commission would consider waiving the Municipal Hall rental fees for the Arts and Crafts Shows, November 4 and December 9 and the Veterans Day event again on November 10th.

Commissioner Williams made the motion that the City provide prizes for three winners of $100 each off of the December electricity bill for the Chamber's Christmas light residential decorating contest. The motion was seconded by Commissioner Hekel. Motion carried.

Commissioner Williams made the motion that the City waive the Municipal Hall rental fees for the Chamber Arts and Crafts Shows, November 4 and December 9, and the Veterans Day Program for November 10th. The motion was seconded by Commissioner Hekel. Motion carried.

WAYNE DENNIS FUND COMMITTEE RECOMMENDATION

Mayor Hatield made the motion that the City fund the Disc Golf Project with the Wayne Dennis Fund for the amount of $4,350 as recommended by the Wayne Dennis Fund Committee. The motion was seconded by Commissioner Koeppen. Motion carried.

RECREATION COMMISSION APPOINTMENT

Commissioner Koeppen made the motion that the City appoint Melissa Prawl to the Recreation Commission to replace Mary Julana Hall who resigned. The motion was seconded by Commissioner Hammersmith. Motion carried.

TRANSIENT GUEST TAX FUND COMMITTEE RE-APPOINTMENT

Commissioner Hammersmith made the motion that the City re-appoint Bette DeMeritt to the Transient Guest Tax Fund Committee as the Chamber Representative as recommended by the Chamber. The motion was seconded by Commissioner Koeppen. Motion carried.

WAYNE DENNIS FUND COMMITTEE APPOINTMENT

Commissioner Hammersmith made the motion that the City appoint Brandon Gerber to the Wayne Dennis Fund Committee to replace Sam Beam who resigned. The motion was seconded by Commissioner Hekel. Motion carried.

LAKE LOT LEASE TRANSFER

Commissioner Koeppen made the motion that the City approve the transfer of Lake Lease for Lot 21W from Jeanne Westeman to Billy and/or Jennifer Hamill. The motion was seconded by Commissioner Williams. Motion carried.

1987 F-150 Ford Pickup

Madsen Automotive- $150; Ireland Sales LLC- $481; Gary Stevens- $327; Jim Roper- $501.51 and Lee Adams- $510.00.

Commissioner Hekel made the motion that the City accept the bid of Lee Adams for $510 for the 1987 F-150 Ford Pickup. The motion was seconded by Commissioner Hammersmith. Motion carried.

1983 S-10 Chevy Pickup

H.D. Mayo- $726.55; Gary Stevens- $77; Lee Adams- $400; Bob Hekel, $1,525; Ron Hartman- $501; Phil Struble- $525; Jim Roper- $389.10; Ireland Sales- $515; A. Clark- $100; Donna Crowe- $350; Frank Hamilton- $513; Harold Madsen- $300; and Brenton Burkholder- $1,111.

Mayor Hatfield made the motion that the City accept the bid of Bob Hekel for $1,525.00 for the 1983 S-10 Chevy Pickup. The motion was seconded by Commissioner Hammersmith. Motion carried, with Commissioner Hekel abstaining.

1988 F-150 Ford Pickup

Jim Roper- $451.01; Ireland Sales- $476; and Harold Madsen- $150.

Commissioner Hammersmith made the motion that the City accept the bid of Ireland Sales for $476 for the 1988 F-150 Ford Pickup. The motion was seconded by Commissioner Hekel. Motion carried.

1992 Dodge Ram 250

Jim Roper- $641.01; Herbert Wilcox- $1,801; Ireland Sales- $1,906; and Madsen Auto- $250.

Commissioner Hekel made the motion that the City accept the bid of Ireland Sales for $1,906 for the 1992 Dodge Ram 250. The motion was seconded by Commissioner Hammersmith. Motion carried.

1982 F-600 Ford Truck

Jim Roper- $601.10; Gary Stevens- $429; John Walker- $5,200; Jeff Parsons- $1,387.99; Ireland Sales- $1,824; Lee Warner- $250; Madsen Auto- $200; Melvin Gilchrist- $851.

Commissioner Hekel made the motion that the City accept the bid of John Walker for $5,200 for the 1982 F-600 Ford Truck. The motion was seconded by Commissioner Hammersmith. Motion carried.

CITY SUPERINTENDENT'S REPORT / FORD TRUCK / AIRPORT BUILDING /

SMOOTH STREETS / KMEA/KMGA MEETING / SPECS FOR BACKHOE AND LOADER /

FINAL INSPECTION FOR HOSPITAL ADDITION

City Superintendent Sechler reported that Vanlandingham Ford reported Ford had cancelled production on F-650 Ford Trucks. The Superintendent talked to large truck dealer in Missouri. The F-650 is available from them. He will pursue prices from the large truck dealers. 2008 models are reportedly going to be $6,000 to $8,000 higher.

Footing for the Airport terminal building was poured last week.

Inland Construction will be here with profile grinder tomorrow to smooth rough spots.

He, Larry Berry and Steve Wilkinson will attend KMEA/KMGA Annual Conference this week.

Bid specs should go out for Loader and Backhoe this week. After discussion it was agreed to ask for bids with and without trade-ins.

He and Steve Wilkinson made final inspection for the Hospital addition last week.

CHIEF OF POLICE REPORT / HALLOWEEN SAFETY PROGRAMS /

MILITARY ESCORT / $225 FOR DRUG FUND /

ENDANGERED CHILDREN MEDIA EVENT

Mayor read the Chief of Police report; Chief Blevins had to leave the meeting.

Presented their Halloween Safety programs to Blessed Beginnings Pre School at Christian Church and K-1 classes and provided candy and glow sticks. Quiet Halloween. Great Parade for kids.

They assisted Harper Police Department with traffic control for Military funeral escort.

Another check received from State of Kansas for $225 for Drug Fund from the Garlow case in 2003.

Invitation is extended to the Harper County Endangered Children Media Event at Chaparral, November 13, at 6:30 P.M.

CITY CLERK/ADMINISTRATOR'S REPORT / I.D. BOARD MEETING /

COUNTY ECONOMIC DEVELOPMENT STRATEGIC PLAN / TAXES RECEIVED /

CLERKS ACADEMY / CODE DRAFT / UTILITY RECEIPTS

City Clerk/Administrator Heidrick reported that the Industrial Development Board will meet for their monthly meeting at the Smokehouse at Noon.

He and Commissioner Koeppen attended the County Economic Development Strategic Plan meeting in Harper, Thursday evening. With the development of the plan, they hope to get better tax credits for business and industry through Kansas Department of Commerce.

City received $35,736.45 in tax money from County Treasurer. $17,823.74 was for delinquent taxes, last year it was $26,972.98 for delinquent taxes.

He will attend Master Municipal Clerks Academy in Wichita this week.

League should be sending draft recodification copy of Code for review soon.

Utility billing is down with corresponding weather conditions from $453,000 to $287,000. Electric has $137,500 to receive from FEMA and then will need to wait for additional approximate $100,000 with FEMA approval which is over initial project amount.

ANNEXATION

Mayor asked about discussing possible annexation again. Will consider East side of 5th Street, and South side of Main. Sewer Plan needs to be developed.

HOUSE NUMBERING

Clarification was made on numbering of houses. Established number does not have to be moved to front door side of the house, just so it is visible from the street.

2006 MILDRED VANCE CITY CLERK AND MUNICIPAL FINANCE OFFICER

OF THE YEAR AWARD

Commissioner Koeppen made the motion to nominate Don Heidrick for the Mildred Vance City Clerk and Municipal Finance Officer of the Year Award. The motion was seconded by Commissioner Hekel. Motion carried.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Koeppen. Motion carried.
