The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Howard Hatfield presiding and the following Commissioners present: Hekel, Dickey, Hammersmith and Williams. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Larry Berry, Karen Younce, Jeannie Barber, and Kenny Hodson.

The minutes of the previous meeting were approved.

APPROPRIATION ORDINANCE and 9/16/08 PAYROLL APPROVED

Claim Ordinance #5557 making appropriation for $86,054.12 for the payments of certain claims against the City of Anthony for Appropriation Ordinance and $45,327.41 for 9/16 Payroll were presented and on a motion by Commissioner Williams, seconded by Commissioner Dickey, said Ordinance and Payroll were unanimously approved and claims ordered paid.

ELECTRIC PRODUCTION DEPARTMENT REPORT

Larry Berry, Power Plant Superintendent reported on the Electric Production Department. Superintendent Berry reported that July gross generation for the Power Plant was 352,400 KWH and August generation was 601,200 KWH. August started with several days with 90 to 100 degree temperatures. Peak for 2008 was 8.5 megs. They upheld the contract demand and while carrying the system load, there were no power outages.

They start winter maintenance as soon as they go back to a five day work week and plan to do this September 22nd. They are working on priority list, with cost of each thing they plan, so it can be shown to and discussed with Superintendent Sechler and City Administrator.

Need to get gas meters installed. Water line project needs to get done. They are waiting for oil samples results back on transformers to see if work needs to be done on them.

DEPARTMENT HELPING DEPARTMENT – EXPENSE STREET DEPARTMENT NOW.

The City Commission discussed the Departments expensing other Departments when they are assisting the other Departments. All Departments do now except when doing work for Street Department. This policy made some years ago was to help keep mill levy down for the General Operating Fund.

It was consensus of Commissioners to change the policy and to have Street Department be expensed like other Departments for work other Departments do for the Street Department.

TREE BOARD REPORT

Karen Younce and Jeannie Barber of the Anthony Tree Board were present to report on the Dutch Elm Tree Disease in Anthony.

Karen Younce Explained how Dutch Elm disease is spread and what happens if a Dutch diseased tree is not cut down and burned.

There was extensive discussion about the detection of Dutch elm disease, and the problems associated with the trees being on private property and following City Code. The trees diseased, needs to be certified to carry out City Code. It was decided to go ahead and send letters to property owners that they may have troubled trees and request that they be eliminated.

Karen Younce also asked about the need for tree trimmers to have Worker’s Compensation since only one does in the area. It is expensive to use the one tree trimmer with the Tree Board budget as it is. It was explained that City insurance carrier will charge the City when an audit is made for the contract work done for the City if the contractors do not have Worker’s Compensation Insurance.

Karen Younce also asked about the City employees attending a trimming workshop, to have more employees trained for tree trimming.

HEALTH NUISANCE FINDINGS AND ORDERS

Officer Hodson presented the Findings of Fact and Order for a health nuisance for June M. Henderson for her property at 304 S. Springfield. Commissioner Hekel made the motion that the City adopts the Health Nuisance Findings of Fact for the property of June M. Henderson, 304 S. Springfield. The motion was seconded by Commissioner Hammersmith. Motion carried.

RESOLUTION NO. 713

A RESOLUTION AUTHORIZING THE CITY CLERK /ADMINISTRATOR TO EXECUTE THE DOCUMENT FOR THE LEASE/PURCHASE.

Commissioner Hammersmith made the motion that the City approves Resolution No. 713 that allows the City Clerk/Administrator to sign all documents for the new Lease/Purchase with Farmer’s Bank and Trust of Great Bend. The motion was seconded by Commissioner Hekel. Motion carried.

PROPERTY CONDITIONS

The City Commission discussed the property conditions for 200 N. Second. Dwight Steele property has a refrigerator, and washer and dryer on property and there was concern about safety. Trotter property on East Main needs mowed. Piles of brush south of Mayor Hatfield’s shop needs to be cleaned up.

CITY SUPERINTENDENT REPORT/HEAVY RAIN PROBLEMS/TENNIS COURT FENCING/ENTRANCE TO INDUSTRIAL PARK/PLANNING COMMISSION AND BOARD OF ZONING APPEALS TO MEET/MEET WITH JOHN HAAS/LAKE AND WATERSHED MEETING

City Superintendent Sechler reported that heavy rains have caused several problems. The Plant had no problems. Some flooding at Wastewater Plant and at least two homes at the lake had water damage. Several roads at the Lake received damage and some culverts were washed out. There is a bridge washed out on the south end of West Avenue. He will ask County about cost to replace this kind of bridge.

The contractor started installing the fencing at the north tennis courts.

The entrance to the Industrial Park property north of town is 50% finished.

Planning Commission met last Thursday for the Public Hearing on the old High School property.

Board of Zoning Appeals will meet on Thursday at 5:00 p.m. for a variance request.

He and Don will meet with John Haas on Thursday to discuss information on the Electric Rate Study.

November 3rd, at 3:00 p.m., there will be a meeting to discuss the possible future WRAPS projects for the Lake and Lake Watersheds at the Soil Conservation Office.

CHIEF OF POLICE REPORT/MULTI-DISCIPLINARY CHILDREN PROTECTION TEAM MEETING/LAW ENFORCEMENT MEETING/CRIME SCENE KIT DEMO/SCHOTT’S BURGLARIZED/GAS TAKEN AT FOREST PARK/ARREST FOR MARIJUANA, POSSESSION, AND OPEN CONTAINER/TO ATTEND KANSAS ASSOCIATION OF POLICE CHIEF’S CONFERENCE

Chief Blevins reported he had attended a Harper County Multi-Disciplinary Children Protection Team Meeting.

Had a Law Enforcement Officers Meeting hosted by County Attorney. He thanked the County Attorney again for all assistance and for equipment and training.

Officer Hodson explained and showed how the new Crime Scene Kit works.

Schott’s True Value was burglarized. Case is being investigated.

There was theft of gas at Forest Park Cemetery.

Officer Matthew Schultz had stopped a vehicle and four individuals were arrested for possession of marijuana, open container of alcohol and minor in possession of alcohol.

Chief Blevins will attend the Kansas Association of Police Chiefs Conference.


CITY CLERK/ADMINISTRATOR REPORT/T-LINK MEETINGS/SALE AD – LAKE LEASE/AUGUST FINANCIALS

He had received information for the T-Link Transportation Task Force Meetings that will be held. A Resolution can be adopted. He presented a newspaper advertisement for the sale of the other Lake Lot Lease and will have it published.

Angie Hartman had completed the August Financial Reports for review.

Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
