The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Barbara Muse presiding and the following Commissioners present: Hall, Tedder, Hammersmith, and Dickey. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; Kenny Hodson, Deputy Chief of Police; Amber Schmitz of the Anthony Republican; Cynthia Clark, Jim Forsyth, Deborah Mangen, Derrick and Jackie Keim, Payson and Maria Hedlund, Dennis Cook, Bryant Anderson, Tammi Greve, Lori Allen Donna Crowe, and John Gaffney.
Jim Anderson of the Nazarene Church gave the Invocation.
Mayor Muse made the motion to approve the minutes of the previous meeting. The motion was seconded by Commissioner Tedder. Motion carried.
APPROPRIATION ORDINANCE
Claim Ordinance #5609 making appropriation for $234,396.25 for the payments of certain claims against the City of Anthony for appropriation ordinance was presented and on a motion by Commissioner Tedder, seconded by Commissioner Dickey, said ordinance was unanimously approved and claims ordered paid.
COMMENTS
Cynthia Clark thanked Grant and the City Street Crew for putting posts for the bridge on 2nd Lake Road.
EXECUTIVE SESSION
Mayor Muse made the motion that the City Commission go into Executive Session for 25 minutes to discuss matters considered confidential in a Client-Attorney Relationship. The motion was seconded by Commissioner Tedder. Motion carried.
At 8:35 a.m., the Commission Room was cleared with the Deputy Chief of Police, Donna Crowe, City Superintendent, City Administrator and City Attorney remaining. At 9:00 a.m. the Mayor called the meeting back into regular session. No decisions were made.
PUBLIC HEARINGS FOR DANGEROUS STRUCTURES
Public Hearings for Dangerous Structures were held at 9:00 a.m. for 129 W. Main, owned by Derrick and Jackie Keim; at 9:15 a.m. for 131 W. Main, owned by Deborah Mangen; and at 9:50 a.m. for 135 W. Main, owned by Payson and Maria Hedlund. Dennis Cook, Structural Engineer from PEC gave a report on the structural condition of the three locations. He reported the buildings are classified as dangerous and unsafe. The three Hearings were recessed until September 28th.
RESOLUTION NO. 748
A RESOLUTION OF GOVERNING BODY ADOPTING AND PROVIDING FOR STANDARDS FOR PROCUREMENT, BIDDING AND CONTRACT AWARDS
Commissioner Dickey made the motion that the City adopts Resolution No. 748. The motion was seconded by Commissioner Hammersmith. Motion carried.
RENTAL CONTRACT
The Anthony Fire Department presented a Rental Contract Application to use the Municipal Hall for the Fire Department Christmas Party, December 5, 2009 and Alcohol Consumption for Exemption Application. Mayor Muse made the motion that the City approves the Fire Department’s Application to rent the Municipal Hall, the Alcohol Consumption for Exemption Application and Waiver of Fees. The motion was seconded by Commissioner Dickey. Motion carried.
FIRE DEPARTMENT REQUEST
Fire Chief Hodson asked the Commission for $700 again to help pay for the Fire Department Christmas Party. Commissioner Dickey made the motion that the City provides $700 toward the Fire Department Christmas Party. The motion was seconded by Commissioner Hammersmith. Motion carried.
EBH CONTRACT – DAM ASSESSMENT
Commissioner Tedder made the motion that the City approves the Contract with EBH to do assessments to restructure the Dam for $3,000. The motion was seconded by Commissioner Dickey. Motion carried.
SUPERINTENDENT REPORT/ ASPHALT LAID/I.D. BOARD MEETING
Superintendent Sechler reported that the Street Crew has laid asphalt on South Pennsylvania and Garfield Streets. Markers have been installed at the bridge at the Lake. He met with the Industrial Development Board and the person wanting to put in an Ethanol Plant. Electric service has been installed at Steve Bellesine’s new house.
LL&G KLINK PROJECT
Commissioner Tedder asked about the LL&G Klink Project. It is complete. He heard pros and cons about the new left turn lanes. He asked about no parking signs. This was discussed for consideration.
URGENT NEED GRANT
Bryant Anderson, Tami Greve, and Lori Allen from the Anthony Medical Center with Attorney John Gaffney were present to discuss the downtown clean up process for the Urgent Need Project. Donna Crowe reported the Environmental Study is done. The Asbestos Testing cannot be done until the Application is complete.
Jim Forsyth, City Attorney and John Gaffney, Attorney for the Anthony Medical Center will work to get information and answer questions so the application process can be complete.
City Commissioners and City Staff expressed appreciation to Donna Crowe for all her hard work and for putting up with problems in the Urgent Need Grant Application.
Deborah Mangen expressed her appreciation.
CHIEF OF POLICE REPORT/200 N. KANSAS BURGLARY/JUVENILE ON HOUSE ARREST/700 N. SPRINGFIELD
Deputy Chief of Police Hodson reported that a burglary is being investigated in the 200 Block of N. Kansas.
A juvenile who was breaking house arrest is back in the Juvenile Detention Center in Hutchinson.
There was a Domestic Disturbance in the 700 Block of N. Springfield.
There is an assault case being investigated from incidents on North LL&G and S. Kansas.
Big Brothers and Big Sisters want to get involved in Harper County.
A stolen Pickup was found on S. Kansas. Two mini-bikes were stolen from S. Pennsylvania. One was recovered.
CITY CLERK/ADMINISTRATOR REPORT/STANDARD TRAFFIC ORDINANCE/DEED FOR GOLF COURSE/DOWNTOWN IMPROVEMENT COMMITTEE/LEAGUE CONFERENCE/KERR’S AND ANDERSON
City Clerk/Administrator Heidrick reported he is still working on the Standard Traffic Ordinance. The City Attorney is currently reviewing it.
He took a copy of the current Golf Course Driving Range Deed to Jim Forsyth.
Downtown Improvement Committee met. They are wanting to have a Consumer Question Survey. They will meet with John Haas of Ranson Financial Consultants and Kevin Cowan, Attorney with Gilmore and Bell to discuss financing.
KDOT will be here to audit Transportation (Taxi) Wednesday.
League Conference Registrations have been faxed.
Kerr’s signed the Promissory Note for their building addition. Mike Anderson still needs to sign papers for property at Burn-site.
Mayor Muse made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Dickey. Motion carried.
