The Board of Commissioners of the City of Anthony, Kansas met in regular session at 8:30 a.m. with Mayor Howard Hatfield presiding and the following Commissioners present: Hekel, Dickey, Hammersmith and Williams. Absent: None. Also present were Don Heidrick, City Clerk/Administrator; Grant K. Sechler, Jr., City Superintendent; John Blevins, Chief of Police; Amber Schmitz of the Anthony Republican; Donna Crowe, Ron Poor, Jim Forsyth, Merle Walker, Creighton Cullop, Steve and Verena Bellesine, Kenny Hodson, Mel and Patricia King.
The minutes of the previous meeting were approved.
APPROPRIATION ORDINANCES and 9/02/08 PAYROLL APPROVED
Claim Ordinance #5555 making appropriation for $43,311.77 and Claim Ordinance #5556 making appropriation for $119,903.24 for the payments of certain claims against the City of Anthony for Appropriation Ordinances and $47,456.59 for 9/02 Payroll were presented and on a motion by Commissioner Williams, seconded by Commissioner Dickey, said Ordinances and Payroll were unanimously approved and claims ordered paid.
ELECTRIC DISTRIBUTION DEPARTMENT
Steve Wilkinson, Electric Distribution Department Head gave a report on the Department’s Activity.
They set 3 poles north of town and took out bent poles, set 4 other poles in different places.
Rebuilt the Prairie Rose Service. Took imaging camera out and did not find any major problems.
Pole east of town got hit by lightning. They have to set a new pole. They are working on the traffic light at Jennings and Main.
Mayor Hatfield asked about the cost to develop Electric Service in the rural. He will look further in getting complete cost. Commissioner Hekel said the City needs to recoup cost for constructing service.
Steve Wilkinson asked about having the KEC Safety Program again. Other programs and cost will be looked into.
EXECUTIVE SESSION
Mayor Hatfield made the motion that the City Commission goes into Executive Session for 15 minutes for Consultation on matters that would be deemed privileged in an Attorney-Client Relationship, with Attorney Jim Forsyth, Chief Blevins, Superintendent Sechler and Administrator Heidrick present. The motion was seconded by Commissioner Hammersmith. Motion carried. At 8:50 a.m., the City Commission Room was cleared with City Attorney Jim Forsyth, Police Chief Blevins, City Superintendent Sechler and City Administrator Heidrick remaining. At 9:05 a.m., the Mayor called the meeting back into regular session. No decision was made.
TRANSIENT GUEST TAX COMMITTEE RECOMMENDATION
Transient Guest Tax Committee Chairman, Ron Poor reported that the Committee recommends that the City provide $2,000 from Transient Guest Tax Fund to the Anthony Municipal Hall Events Board for advertising and promotion and cost of the Ronald and Avis Romm Piano and Trumpet Duet.
Commissioner Hammersmith made the motion that the City approves the $2,000 for the Romm event as recommended by the Transient Guest Tax Committee. The motion was seconded by Commissioner Williams. Motion carried.
HANDICAP FISHING PIER GRANT/STREETSCAPE/TRAILS GRANT APPLICATION
Donna Crowe reported that the Handicap Fishing Pier Grant Project should be completed by December unless an extension is requested. An advertisement for request for bids will be in the Anthony Republican this week. It is 50/50, $12,000 Grant and City share to come out of the Lake Capital Improvement Fund. City will have In-Kind contribution for dirt work and shoreline work for the project.
She also reported the benches and trash receptacles for the Streetscape Project at Memorial Park are here and walkway lights will be coming.
In discussion for additional fencing for Memorial Park, the Recreational Trails Grant Program, Grant Application should have over 50% for the trail-walking path development. With the construction, A.D.A. accessibility requirement should be met.
LEAGUE OF KANSAS MUNICIPALITIES CONFERENCE DELEGATES
Commissioner Hekel made the motion that City Administrator, Don Heidrick be the delegate and Superintendent Grant Sechler be the alternate delegate for the Annual League of Kansas Municipalities Conference in Wichita. The motion was seconded by Commissioner Hammersmith. Motion carried.
PHIL’S CAR WASH - EXPRESS KEY TERMS AND CONDITIONS FORM
The City Commission discussed the Express Key Terms and Conditions form for the City for use of Phil’s Car Wash. It was consensus to have each Department have their own keys, and request that a 30 day notice of any change for the Terms and Conditions be given.
FINDINGS OF FACT AND ORDERS
Officer Hodson presented Findings of Fact and Orders for several properties.
Commissioner Williams made the motion that the City adopts the Health Nuisance Findings of Fact and issue the Order for the property of Georgia L. Williams 217 S. Lincoln, C/O Jim Williams. The motion was seconded by Commissioner Hekel. Motion carried.
Commissioner Hekel made the motion that the City adopts the Health Nuisance Findings of Fact and issue the Order for the property of Ronalda L. Prince, 202 N. 2nd. The motion was seconded by Commissioner Hekel. Motion carried.
Commissioner Hekel made the motion that the City adopts the Health Nuisance Findings of Fact and issue the Order for the property of Ronalda L. Prince 210 N. 2nd, the motion was seconded by Commissioner Hammersmith. Motion carried.
LAKE SEPTIC SYSTEM DEVELOPMENT
Commissioner Williams made the motion that the City approves the position statement for the Lake Septic System Development at the Anthony Lake on Cattail Cove Circle, East of Lake Lot #1E. The motion was seconded by Commissioner Hekel. Motion carried.
LAKE LEASE AUCTION
The Mayor opened the discussion for the review of items to discuss before the Lake Lease Auction. There was also discussion of the City’s position on the Septic System Development for Cattail Cove Circle, East of Lake Lot # 1E. The City Clerk/Administrator read the statement and also the published announcement of the Public Auction for the leases for the two separate unimproved Anthony Lake Lots. The Auction is for the Lake Lot Leases not the land.
The Mayor opened the Auction to receive any bids for the lease of the first Lake Lot. Steve Bellesine’s bid was $10,000.00. There were no other bids. Mayor Hatfield declared the lease for Lot 1 was sold to Steve Bellesine for $10,000.00. 40% will go into the Capital Improvement Fund and 60% will go into the Lake Maintenance Improvement Fund. There were no bids for Lot #2.
PLAYGROUND EQUIPMENT
Creighton Cullop asked about the old playground equipment that was to be placed on the West side of the Lake.
EMPLOYEE LIFE TERM INSURANCE
The combining of the Life Term Insurance coverage for the employees will save the City money. The employees have been paying 25 % of the monthly premium, for the Advance Life Insurance. After discussion it was consensus of the City Commission that the payment by the City employees be dropped, since the saving for the new insurance plan will be $96.00 for the city and the employee’s have been paying 25% amounting to $56.32 on the present old policy.
LAKE LEASE TRANSFER FOR LOT 32E
Commissioner Hekel made the motion that the City approves the transfer of Lake Lease for Lot 32E from Clarence F. Stimits and/or Ann L. Palmer Stimits to Carl M. Schmidt and Diane S. Schmidt, H/W as Joint Tenants with Right of Survivorship. The motion was seconded by Commissioner Dickey. Motion carried.
APPLICATION FOR RETAIL ALCOHOLIC LIQUOR FOR CONSUMPTION ON THE LICENSED PREMISES WHICH MAY BE OPENED TO THE PUBLIC
Commissioner Williams made the motion that the City approves the Application for Retail Alcoholic Liquor for Consumption on the Licensed Premises which may be opened to the Public, for Bob Jo Inc. d.b.a. Idle Hour at 125 E. Main, Anthony, KS. The motion was seconded by Commissioner Hekel. Motion carried.
CITY SUPERINTENDENT REPORT/SUNRISE STREET LIGHTING/I.D. PARK ENTRANCE/LAKE CARETAKER POSITION/STREET CHIP AND SEALED/HANDICAP RAMP/LAKE SEPTIC SYSTEM
City Superintendent Sechler reported that John Scott with Interfaith Housing had said they have no plans for any street lights at Sunrise Addition. He is to look into pricing poles for Wheatridge Street.
Contractor is supposed to start on highway entrance for K-2 Industrial Park on Tuesday.
He had priced concrete cost for replacing 6” curb as requested by Commissioner Williams. Grant thought the street crew could do this work.
Jay Hall was hired for the Lake Caretaker position. There was discussion that the position be connected with Water Department under the supervision of the Department Head. This will be done.
The Street crew has chip and sealed 6 blocks of City Streets. They will continue as long as weather permits. They removed concrete for handicap ramp on South Bluff.
The Water/Wastewater Department has installed 75 chambers on the septic system on the West side of the Lake.
More information was sent to John Haas for the Electric Rate Study.
Planning Commission Meeting is scheduled for Thursday, September 11, at 6:30 p.m. in the City Commission Room. Their will be a Public Hearing on possible rezoning of old High School property on North Anthony.
COMMISSION COMMENTS
Commissioner Hekel would like a comparison of cost per KWH for customers from other towns.
Mayor Hatfield asked about the need for house trailers to have address numbers for emergency calls.
Mayor asked about Wind Power to produce Electric Power. Information on how it could be used for Anthony is needed. There is a Wind Power Conference in Topeka September 23rd and 24th.
LAKE LEASE SALE
After discussion Commissioner Dickey made the motion that the notice for the Sale of the second Lake Lease be advertised for a minimum sale price of $10,000.00 with the same stipulations as were required for the auction, sale and be sold on a first come first served basis, subject to approval of the Anthony City Commission. The motion was seconded by Commissioner Hekel. Motion carried.
CHIEF OF POLICE REPORT/MARKED UNIT BACK/HOUSTON BACK TO WORK/DOMESTIC DISTURBANCE – PROBATION VIOLATION/TRAFFIC MONITORING
Chief Blevins reported that the marked unit is back in service. Officer Houston is back to work. They have investigated indecent liberties case involving two juveniles.
There was disturbance in 300 block of North Santa Fe.
There was a probation violation for Todd McMurray. He received sentence of 155 months in prison.
Commissioner Hekel asked about the speed for issuing speed violation citation, that it should be six miles per hour over the speed limit instead of ten.
The Police are still monitoring the traffic on Garfield.
CITY CLERK/ADMINISTRATOR REPORT/TAXI SERVICE/TREE BOARD/LEAGUE CONFERENCE
City Administrator reported that he had talked to Stacy Cowan of KDOT about the Taxi service, at the Transient Meeting at Kingman. She had indicated that KDOT would still want the taxi service to merge with County Transportation eventually.
Tree Board has requested that the City send letters to property owners who have trees that appear to be diseased.
He announced that registration deadline for the League of Kansas Municipalities Conference is September 26th. Room Reservations have been made for Commissioners Hekel and Hammersmith, Superintendent Sechler, Chief Blevins and City Clerk/Administrator Heidrick.
TREE BOARD REQUEST
After discussion the City Commission would recommend that the Tree Board certify that a tree is diseased before the City notifies the property owners the tree needs to be cut down and burned.
Commissioner Hammersmith made the motion that the City Commission meeting be adjourned. The motion was seconded by Commissioner Williams. Motion carried.
